Tier-1 dependant for wife

Post by venkat82 » Mon Jan 30, 2012 5:10 pm

Hi All,
Me and my wife entered UK on their own individual Tier-1 visas in 2010.Now we are due for extension. Can my wife switch from her tier-1 to tier-1 general dependant without leaving UK.I called UKBA,they told i need to do this from home country and not with in UK.This looks like a unique case.Any suggestions?.

no it's not a unique case, plenty of similar cases including mine.
Wife needs to enter from home country as your dependent.

Hi Harsh,
Thanks for that quick reply. So its confirmed that i cant do sitting in UK:-).

When i apply for my wife to convert from tier-1 to tier-1 dependant in home country wont they question why do u want to switch?.

Will they cancel tier-1 and give tier-1 general dependant?.

i don't think so that they care about why somebody is cancelling tier-1 and going for tier-1 dependent as long as the documents are in place and correct fee is paid.
on the side notes, this is one of the stupid rules where tier-1 holder spouse cannot become dependent of his/her tier-1 holder spouse. don't see any reason behind it.

what he means is: The rule is STUPID.

The point is you can't switch from within UK. The switch can be done from your home country only.
