ILR visa stamp and letter dates

Post by santoshganpath » Tue Jan 31, 2012 12:25 pm

All,

I received my ILR visa today. The visa endorsement in the passport has yesterday's date (30 Jan 2012) but on the ILR letter the case worker mentioned that I am free from Immigration Restrictions from 08/10/2010. cannot understand why. Actually I made ILR (Set O) application on 07/09/2011. Free from Immigration restrictions should have been from 07/09/2011.

And the letter mentions that my application has been considered under the criteria of HSMP JR.

I do fall under HSMP JR policy but not under 4 year rule, I still have to complete 5 years since I got the initial HSMP visa on 14 Sept 2006.

Now my question is as per the ILR letter that specifies that I am free from immigration restrictions from 08.10.2010 does it means, I can apply for Naturalisation (British Citizenship) immediately?

Could some seniors advise what to be done?.

Many thanks & kind regards...
Santosh

Can you mention the exact visa types as stated on the Vignette on your Passport for initial and extensions ?

Congratulations Santosh,

Can you tell me what date you actually posted your initial HMSP application to UKBA?

Thanks

Thanks for your replies.

Here is the timeline of my HSMP initial application.

I sent my initial application for HSMP consideration in March 2006 but they refused as I missed to submit some documents.

So, by the end of May 2006 again I reapplied for HSMP, then I received approval letter on 18 July 2006.

As per the switching rules during that time (I was on student visa before applying for HSMP), I was advised to go back to India for visa endorsement and the visa was issued in Chennai British High Commission on 14 Sept 2006.

@ suneel.suneel

In the initial HSMP visa, the type of visa mentioned is: Highly Skilled Migrant Programme (Valid from 14/09/2006 to 14/09/2008). This visa was issued in Chennai BHC, India.

In the extended visa, the type of visa mentioned is: Tier 1 (General) Migrant (Extended until 14/09/2011). This visa was issued in Sheffield, UK on 05 Sept 2008.
-----------------------------

I am not completely sure now when to apply for Naturalisation, but I think it may be better to wait 6-years from the date of my initial HSMP date which will be 14 Sept 2012.

May be the caseworker might have done some "typing error" in the ILR letter.

Any advise would be appreciated.

Regards...
Santosh

All

This is the content regarding immigration restrictions in my ILR letter

---------------------------------------------------------------------------------
"Your application has been considered under the HSMP Indefinite Leave to Remain (ILR) judicial review: policy document. Under the terms of this policy you are deemed as having been given ILR on 08/10/2010. You are therefore considered to have been free from immigration restrictions for the date specified.

If you submit an application for British Citizenship you should include a copy of this letter with your application. This will allow the date on which you are deemed to have been granted settlement to be taken into account."
---------------------------------------------------------------------------------

I would be grateful to anyone if they could let me know when I would be eligible for Naturalisation.

Regards...
Santosh
