to be employed for ILR?

Post by meet2tripathi » Wed Feb 01, 2012 7:57 pm

hello friends

i am going to be eligible for ILR by 29 Apr 12 as my first entry to the UK was 30 Apr 07. is it necessary to be employed while applying for ILR in first week of May 12?
the reason i am asking this because i am planning to quit my current job by end of current month i.e. Feb 12 for a personal reason.

Will it be ok to show income for Mar 11 to Feb 12 as last continuous 12 months income? even though i will not be employed when I apply i.e. first week of May 12.

thanks in advance.

Yes, that should be fine.

You do not need to be employed at the time of applying, the only criterion is you should meet the earnings requirement in any 12 consecutive months in the last 15 month period. This is true even if you had no earnings for a part of that period.

You didn't say which visa you are on. For WP or Tier 2 you must be employed.

Thanks InUkOnHsmp.

@genorp,
i am on Tier 1 (G) at the moment.
it's standard HSMP->Tier1->Tier1 (Extension-> ILR route.
However my only doubt was the the employment state while applying for ILR.

i think i would be able to consider 12 months income period being Mar 12 to Feb 12. As my application date will be 1st week of May.

you can apply upto 28 days in advance, so if you are completing 5 years on 30th April, you can apply 1st week of april - that will reduce the period of unemployment.
