Holidaying on a near to expiring WHV

Post by clizzywizzy » Fri Oct 20, 2006 4:12 pm

How close to a working holiday visa expiring will it still be ok to leave and re enter the UK with no hassles? My partners WHV expires 2nd Feb 07, we plan to go on holiday to France for 4 days on 8th Dec. Will he get a grilling at immigration when we return or will he easily be let back in?

This really depends on what proof you partner will have of his/her intentions to leave the UK when the time is due.

Personally, I would take his/her flight confirmation back to his/her country of origin, so that this could be presented to the Immigration Officer back in the UK.

Also, any other reliable proof of his/her intention (or even better, necessity) to leave the UK on 2 Feb 07.

Remember that the onus is on your partner to prove he/she will leave, the more proof he/she has, the easier it will be for him/her to be allowed back in.

Does the onward ticket HAVE to be back to his home country...New Zealand? We are going travelling around Asia, leaving on the 31st Jan but the tickets are to Bangkok, will this be enough proof?? Thankyou

I think it would be a good start. After all, that scenario makes sense (as indeed does a short break in France before you do leave), and the point of interest to the immigration officer (in this regard) will be whether your partner is going to leave the UK on or before 2 February. Remember, immigration decisions at the point of entry are generally made on the balance of probabilities, as the immigration officer views it - so the more proof you have and the more cogent the scenario, the less likely there are to be problems.
