Tier 1 extention - No earnings for two months - how to cover

Tier 1 extention - No earnings for two months - how to cover

Hi,

Currently I am in UK on Tier 1 & my visa is due for extention in coming months.

However, I am jobless for two months, which fall under 12 month period.

Could someone suggest me how to cover up the earnings gap?

I would really appreciate your time!

I assume, you were contracting through an Umbrella company, rather than using your own limited company?

You are also asking the group members to provide details of an umbrella company that would help you fake your salary for these months?

If you were using you own company, you could have just pooled the money in the business account and paid yourself regularly. You generally have to plan for your extension in advance and you just can't do it in one day.

is your 10 months salary not enough to get required points?

I wouldn't bother replying to this thread. The OP asked for advice on how to fraudulently claim income, and then proceeded to edit his post after someone raised it.

I don't think this is a question of 10 months salary. The point is there is a gap of 2 months in the 12 month period.

What I am not sure of, if UKBA will consider 12 months period in which you have not worked for 2 months in between. Lets say you worked Jan to April and then didn't in May and June and worked again July to Dec.

The guidance says that you can claim the salary for a maximum of 12 month continuous period out of the last 15 months.

well QuickSam, you are right. i think someone can claim last 10 months out of 12 months provided
a) last 10 months salary enough to get required points
b) last 10 months must be continuous

please correct me if i am wrong here.

the problem is the OP has edited his original post - in which he said that he didn't have enough earnings in the 10 months and wanted to find an umberella company to pay to produce his payslips for the last two months during which time he was not working - essentially he wanted a way of faking his salary.

Ignoring the OP (for the reasons mentioned above), can someone confirm if harshil223's above point is correct? If I've read the rules correctly, it doesn't matter if you worked (e.g.) one week in April 2011 and then one week in October 2011 and then you apply to renew in Feb 2012, so long as the minimum income requirement is met with just those two weeks' earnings.

What the "continuous" refers to is that you can't claim 3 months from 2009 and then another 9 months from 2010 - correct?

If someone clear about what "continuous" means would be great help.

Again assuming in last 12 months you were employed for first 6 months and then unemployed for 3 months and back on job for last 3.How would you count "continuous".

"Continuous" means a consecutive period of 12 months. It doesnt matter if you were working for all 12 months or not so long as you meet the income criteria.

If you lose your job for a month in between the 12 month period under consideration then thats fine, the income for that month would be 0
