Tier 4 Academic Progression Rule

I need some help with Tier 4 Academic Progression Rule. Does this means if someone had a highest UK Qualification can not study any further subject even after a gap of 5 to 6 six year?

what do you mean by a 'highest UK qualification'? what course have you studied perviously and what course are you hoping to study now?

I have MSc in Quality Management and PhD qualification within same filed
Now looking to join an MSc in Human Resource.

it would be up to your tier 4 sponsor to confirm that you are making academic progress in taking a lower qualification. Have you applied to any universities to do this course?

Yes and got refused Under Para 245ZV(b). In my case academic progression was mentioned.

didn't the university confirm that you were making academic progress in your CAS? were they aware of your previous qualifications?

Yes they did mentioned academic progression. it was the ECO who was not satisfied.

The T4 Sponsor wrote that "they believe that this new course demonstrate a Genuine Academic Progression but eco said in refusal that an academic progression means only if " student will be studying at a higher academic level or at same academic level that complements or enhance previous study at the same level"

is that all they said about academic progression or did they put more information to justify their assessment? have you spoken to the university about it? Did they know about your previous course?

Well as far as University registry / international office concerned they only received my relevant qualification which fulfils the academic requirement(s) in order to gain entry into MSc but I have discussed my academic degrees with concern PD. On the other hand the concern eco only defined 245ZV(b). Here I want to illustrate that I was completely unaware about the requirements of above mentioned law and feels very unfortunate because my last stay was completely legitimate and had done nothing other then studying in the UK and the only intention of mine was to gain a relevant degree which could help me in my chosen career.

Generally your case clearly shows that you are just trying to prolong your stay or just want to come in UK on student visa. You already have done MSc and PhD in your desired field and now you choose the field which looks totally different from the previous and unfortunately, immigration laws do not allow this anymore.

Plus, if you don’t know the law that does not mean that it will not applicable on you. Having the knowledge of the relevant immigration laws is a responsibility of immigrant. And previous ligitimate stay will not exempt you from any further legal requirement.

So, your last option is, consult with any good immigration lawyer and get advice to go for appeal or something.

I agree with your comments. Just to clarify that I had business visit visa to visit UK and had no real need to gain entry through any unwanted route.
