Congrats everyone who received their passports. It looks to me once you are over 12 weeks, you are waiting forever. It is either less than 3 months or forever. :(

Speed120,

I'm sorry to have to suggest this but have you considered legal action? Because surely if you have complied with the rules, waited the 6th month allocated etc. for information and now this shabby treatment. I'm sorry but it isn't right.

Perhaps suing them will get their attention. How utterly unfair. What possible reason could they have to keep denying you your documents?

Anyway, I have to sign off now. I'm travelling to be with my ill son who's going to have an operation. Wish us well and hopefully, we'll meet again in the citizenship forum.

A very good luck to all of you and thank you very much :D

Sent my application for ILR on set M on 21/11/2011 via next day recorded delivery; tracked documents to ensure they have received it on the 22/11/2011.

Three months on,Homeoffice/UKBA have sent me a letter today dated 04/02/2012 telling me they can't find any of my supporting documents including my passport and my wives. The only document they reckon they have is my life in uk test, marriage certificate and education cert.

The worse part is that, they are asking me to resend the document which they have misplaced before they can consider my application.

I am confused because don't know how I will be able to obtain all that within this short period. Can somebody advice what action to take; is there anybody on this forum who have had this experience with OH?

May be you should try to give them a call & hopefully, they may advise you, did you make any photocopies of the documents? Their negligence is shocking!
Sorry to hear that gid1818. I think they should check all the documents before they take the payment. By the way, if you have the photocopies of the documents, what can you do?[/quote

Dear All,

I applied for ILR visa in April 2011 on Set M form and haven’t received my passport back yet. Whenever I contact the concerns through phone/letter they say that the case is still under process. It is over 10 months now that I submitted my case through Settlement Checking Service and I am getting frustrated now as it is getting too long and I have holidays coming up as well.

Any suggestions what should I do? Should I go to Croydon in person or what ???

Please advice.

Thanks.

common sense?!

Post by polly_s » Sun Feb 12, 2012 8:37 pm

dont quite understand people's thinking: why get involved with solicitor and waste money, then send docs by post and save money this way?!

if you had money for solicitor, surely just apply in person and get it all sorted on the day?!)

i think people who have complecated applications not that honest here and worry those who have truly straight forward application ..

Is the processing of ILR application on 10 yrs residency done differently ?

I guess these are also Postal Applications ?

Just had a look at the other link in this forum and am quiet happy to see that the average waiting time is just 10.7 weeks.

http://www.immigrationboards.com/viewto ... start=2340

At least UKBA has done good job for those applications and we should be happy for all those who did not have 2 go through torturous wait.

I know that the wait is torturous for postal application.

Speed120 and Amaraza, I hope you get your ILR very soon.

I can understand concerns of Speed120 as he is on the top of the list.

Friend you will get it soon. Just waiting to hear good news from you.

if you had money for solicitor, surely just apply in person and get it all sorted on the day?!)

i think people who have complecated applications not that honest here and worry those who have truly straight forward application ..
I wouldn't say that. I have applied for SET M and now waiting for over 14 weeks. I have a pretty straightforward case. We have tenancy agreement to both our names for the last 2 years. Council tax, all utility bills are all on both our names. We are both working and both have generous salary above national average. (paying quite a lot of tax) No benefits, no dependants. Bank statements with good account history. We sent utility bills more than 3 different sources and a lot more than 6 letters.

I just think that some case workers are lazy and your folder is just sitting around and it can even be forgotten for some time. I think each case worker is allocated with a number of case. Some are slow and some are quick. That's my opinion.

The wait is unbearable and nothing can justify holding someone's passport for more than 6 months with no information given. not even a complicated case. It is so wrong and I cant understand how they can get away with it.

Trust me , they are lazy , they can't their job properly , some people there got conscious and they do their job , some that they just their for fun because they know if you complain no one cant do anything about it , imagine my friend with a caution and he got in 5 weeks , but he was working like a machine 12 hours shift a day 6 day a week sometimes 7 and he was earning quiet a bit ,so like you said its just your luck where ur application is
