Staying after expiry of leave to remain..

I have a small query regarding Tier 1 extn. Pardon my ignorance if this is a stupid question. In below mentioned case person's visa expired on 04-Feb-2012 can he still work or stay as he has not received documents/visa or result whether he has been granted visa or not.

1. Current vignette: Tier 1 (General)
2. Date of expiry of current leave: 4 Feb 2012
3. Number of applicants: 4
4. Date application posted: 13 Jan 2012
5. Date application received at UKBA: 16 Jan 2012
6. Date payment debited: 18 Jan 2012
7. Payment mode : Debit Card
8. Acknowledgement letter received: 21 Jan 2012 (dated 18 Jan 2012)
9. Biometric letter received: PENDING
10. Date of biometrics enrolment : PENDING
11. Date passport & documents received: PENDING
12. Date BRP received: PENDING

Untill the decision result comes, you will be in your existing visa status. In your case Tier 1 General.

No issues.

Thanks Mate... however if because of some reason my visa is rejected then do i have to leave immediately or i can reapply and stay till next decision is made.

Hi Blackeyed,

If your visa is refused for any reason and the visa expiry date has passed, you will be given a right to appeal the decision and as such you won't need to re-apply.

Your visa status during the appeal period will remain unchanged.

if visa gets rejected, how much time do you have after receiving the rejection to stay in the country?

thanks so if visa rejected today

then + 28 days to appeal

and + X days till you get the result of the appeal?

ANd presumably your status is the same till the time you get the results of the appeal?

Yes covered by 3c when application is in process and 3d when appeal is in process. Read Section 3c & 3d of Immigration Act 1971 for more details.
