Penalty notice for theft/Shoplifting

Hi All

I am on Tier 1 Gen and its due for extension early next year.I am having my wife as a dependent here. I am working as Mechanical Eng and Every thing was fine like earning,funds etc

Now I have got a problem.

My wife was wrongly accused for shoplifting in a market(try to pay less than actual price .The price was 3£ and my wife tried to pay 1.50)) last month and police gave her a 80 pounds penalty notice For theft on spot.

As my wife is in UK from only last 2 months ,she can not speak English hence she could not explain to police properly.

She paid the penalty after 2 days with the help of her friend.

I was out of country and I just came back and she told me all this. I can not challenge it now as it paid.I am worried about our visa extension which is coming early next year.

Do I need to declare this penalty notice on application form or NOT?

How can it effect her application?

Please guide me what to do in this situation as I am very worried.I will be thankful to you all.

I have read it but I am still bit confuse.Could you please tell me simply,

Does this penalty notice we need to declare or not and if we declare does it effect her application.

It is a bit complicated, so please read that again, and in particular :-
Being issued an FPN by police or any other public authority is not a criminal conviction.
So if asked to list convictions then this event would not be listed, would it!

I understand that we don't need to mention this in conviction section as this is NOT a conviction.

Does this mean we no need to declare this in good character question section too.

Hi Nick, Can you please shed some light on this. What was the outcome of your wife's visa .. Did she got d visa .. Also did you mentioned about this incident in the application .. Do respond when u get time. Thanks

If Police didn't arrest your wife then she is not caution or Charged. Police can't charge or caution someone without arresting him or her.

I would suggest you to go to any Police station and ask for a Form for Data Protection Act and submit it with £10.

you will receive your criminal record report in post from police. it will show you if she is convicted or not.
