ILR due in May 2012

Hi There

I got my HSMP based entry clearance on 21 May 2007 and Tier 1 extension in april 2009. I entered the UK on 01 Jun 2007. My current tier 1 visa is valid till 21 May 2012.

Please can someone advise on following:

1- If I calculate 5 year based on my initial entry to UK on 01 Jun 2007, I complete 5 year on 01 Jun 2012 and minus 28 days - comes to 04 May 2012. Should I book appointment for 04 May 2012 OR should I calculate 28 days based on initial HSMP visa stamp date which is 21 MAY 2007 ?

2- I am considering to apply via fast-track services either same-day/solicitor or in-person/peo appointment. Plz advise which option is better ?

I appreciate your assistance in advance.

I think you are eligible for ILR 28 days prior to 21 May 2007 (Entry clearance date )

You can apply 28 days before your hsmp date.

thanks for the clarification, I will aim to apply on or after April 24, 2012 ( which is exactly 28 days before 21 May 2012 - entry clearance date )

I can see that PEO appointments are really hard to get, so I may or may not be able to get the ideal dates. In that scenerio, is it advisable to use same-day solicitor who can arrange booking in advance for exact dates to apply for ILR ?? Are there any disadvantages of using solicitor ??

I have no experience with solicitors before, but thinking to use one on this occassion ONLY FOR THE PURPOSE OF being able to apply for ILR on ideal dates.

Hi hsmp2007Tier1, I also left some messages to you as my dates are very similar to yours. Please check you inbox whenever you get a chance.

You don’t need to use a solicitor just for the purpose of same day service as there are plenty of slots available for ILR application.


Even the solicitors are losing the privilege (or might have already lost) of having dedicated slots at PEOs, and you can easily book an appointment yourself.

Also you can book an appointment 42 days in advance. So the earliest you can book PEO appointment is 12th March 2012 (which is 42 days before 21st may 2012).

I will go for Croydon, as thats the nearest to where I live. I hope we easily get the PEO slots when they become available. Have you passed the life in uk test ? I have just started looking into that...

So I think we should be fine if we apply on 23rd of April. Which PEO you are planning to use ?
I will probably go for Croydon as they have more slots than any other PEO (it’s also the head office of UKBA and they have more senior staff than other offices).

Yeah I passed the LiUK test in last April as there is no expiry of this test at the moment.

I would suggest you start preparing for it and take the test at your earliest.

Hi Dude,

You mentioned your entry date at UK is : 01 Jun 2007 hence 28 days minus from this date will be your qualifying date to apply for ILR.

Count 5 Years from your 1st entry at UK , not the visa stamp date.

This is safest option.

aps: this was true before mid 2010 but after that UKBA revised the guidance which allows people to apply 28 days before the 5th anniversary of their visa stamp date (as long as you have entered within 90 days of getting the visa).

If someone got work permit 2nd may 2006 but traveled on 10th may 2007 , he/she will need to calculate 5 yrs from 10th may 2007 --- Is that correct ?

That’s correct aps 5 yrs from 10th may 2007 as the time between visa stamp date and entry to UK is greater than 90 days.
