ILR Divorce but ex-Wife not in UK

Post by Aboudi10 » Tue Feb 14, 2012 9:33 pm

Hello All,

I need urgent help for a friend who has ILR on asylum status but when he entered the UK 10 Years ago he was married in his home country Somalia so he mentioned his wife to the Home Office.

However now that they have been separated for many years they have decided to end their marriage.

What he needs now is to notify the Home Office of changes to his circumstances but he has been told it could take upto 2 years to update.

Can anyone guide as he wants to get married in the near future.

Regards,

Ali

It doesn't matter how long they take to update their record...ur friend should notify them because once he gets married and if HO raise any query then he can reply that he did notify HO.

why does he need to tell the UKBA he has got divorced? He has ILR - his marital status is not relevant. If he intends to marry in the UK he will need to show that he is free to marry - but this has nothing to do with the home office. Similarly if his new wife is going to apply for leave as his spouse he may need to provide evidence of his divorce with her application, but there is no need to inform the UKBA of his 'change in circumstances'now.

Hello,

Thanks for the response.

So what evidence does he need as ex wife is in Yemen and is a letter enough to HO or does he need a divorce certificate

And his main concern is that it could drag for 2 years for HO to recognise him as Single.

Any advise is appreciated

Thanks
