Hi Guys, I am on Tier-1 general migrant and it is due renewal on 23rd July 2012. I started employment in UK on 7th Feb 2011.

There is a criteria for earning points for Employment where you will have to provide employment of 12 consecutive months with the last 15 months. I checked the form today and there is a section where it is asking to put the start date and end date of employment.

Now, my last working day with last employer was 23rd Feb 2012 and I have joined the new employer today(27th Feb 2012). Clearly there is a gap of just 1 day (24th Feb 2012). I have the payslip of the last employer and will get the same from the current employer for March for sure.

Will this 1 day employment gap (on 24th Feb, friday) affect my extension? I talked my new manager and he said he can issue a letter with a justification. Should I really bother about this 1 day factor even though there will be a continuity of my employment on a month basis!!!

one doesn't need to be in continuous employment - so no issue with the gap.

So, basically you are saying - as long as there is no gap in MONTH, it will be fine....??

I mean as long as you have last 12 month's salary slip and also the bank statement of every month where you are able to encircle the salary credit row it is absolutely fine?

This is what the form says -

Period(s) of earnings claimed
J1. Applicants can claim points for previous earnings for any single, consecutive 12 month period from the 15 months immediately before this application. The only exception to this is where the applicant has taken a period of maternity or adoption-related absence.

Employment doesn't matter, earnings does.

You can claim point for a consecutive 12 months period but doesn't mean you have to in continuous employment during that 12 month.

There are cases where applicants were unemployed for 1 or more month within the 12 month period. The income for that period will simply be 0.

As long as the total income within 12 month fetch the required point, you are fine.

Thanks for the reply. This do relieves me a lot. But would be absolutely fine if I can get in touch with someone who has recently gone through this situation,.

Is there anyone in this forum who had the exact similar situation and was successful in his/her tier-1 extension?

Dude, stop worrying on this one. There is no doubt whatsoever. There are metric tonnes of people who are not employed all the time.

And it includes me - multiple months. Multiple gaps. And I am not worrying about this aspect.

Thanks Vega..... But you are I think yet to file for extension... Just for my own satisfaction, I need to know someone who has already received extension even with the employment gap within the last 12 months of their extension...

I was out of job from 17-06-2011 to 10-07-2011.I got my extension on 2nd feb 2012.
You can in or out of job but the thing that matters is you earning for the 12 consecutive months.

tapas_16880 this is just to put your mind at ease. extracts from the Policy Guidance document which says:

83. An applicant does not have to be in
continuous or full-time employment during the
12 months being assessed.

84. An applicant may claim for a period of
earnings of less than 12 months if they have
earned sufficient funds to claim the necessary
points.
