ILR - 53 days short

ILR - 53 days short

Hello friends

I got my Tier 1 visa on 1st May 2009 and due for an extension 2012.

I entered the country on 29th May 2009 I am planning to go for an extension on 16th April 2012 same day PEO appointment.

If I get my extension visa on 16th April 2012 it would be till 16th April 2014 if I want to go for ILR on 7th April 2014.

I am falling short by 53 days for the 5 year ILR requirement. Pls note I have never left UK from 2009 till 2012 nor do I intend to leave until 2014 even for a short period.

Will I need a second extension for ILR for falling short of 53 days or will I be granted ILR on basis of this stay.

Please help with your advice

The 53days absence will not bar you from applying for ILR by 2014 unless they change their rules as regard this issue before then - as they usually do!!

when you have a visa until 29th May 2012, y ru going for an extension on april 16, 2012. I am asking this question because you have mentioned that you are not going to leave the country even for a short period until 2014. To be always on the safer side apply for your extension near to the date of the expiry.
