Post by saketjalan » Mon Mar 05, 2012 11:07 pm

I got my ILR in Oct 2011,
Is it right that I can apply for naturalisation after 9 months if I have a mortgage. One of my friends from eygpt applied through a solicitor and managed to get it in 9 months. please advice.

having a mortgage bears no relevence whatsoever to applying for British citizenship.

It may be possible under 7.5.

Do you satisfy any of the conditions mentioned in 7.5?

Then you should wait at least until the 12 months is completed.

Actually it is possible to apply 90 days before as per 7.5.(d).

Solicitor must have drafted covering letter pointing to this clause and submitting documentation for estate and mortgage etc.

OP (saketjalan) would it be possible for you to check with your friend about the letter and contents of the same that solicitor submitted with his application ?
Winning isn't everything, but wanting to win is.

You are right. For clarity I reproduce 7.5 d
the period of limited leave was between 10 and 90 days at the beginning of the 12 month period, if other statutory requirements, including the other residence requirements, are met and the applicant has demonstrated established links through the presence here of home, family and a substantial part of estate;
The worrying part is the definition of substantial part of estate. How the case worker interpret this

As applications can take anytime between 2-6 months for most cases and as no one really knows how long his application would take, trying to cut 3 months with the risk of the discretion, doesn't seem logical to me.
