FLR(M) declined, no appeal, ACCESSING NHS

Hie everyone please I need your help. I am writing on my husband's post and please bear with me. I just wanted to give breakdown of events as this may allow people to respond appropriately.This is my case:
Nationality: Zimbabwean

1. Came to UK on 2year student visa in 2004
2.In and out of hospital most of 2005
3. applied further leave to remain October 2006
3.refused Jan 2007 with right of appeal
4.Appealed late due to lost post Feb 2007
5. Appeal dismissed April 2007
6. appeal rights exhausted March 2009
7.Claimed Asylum March 2009
8. Refused September 2009
9. appeal Sept 2009
10. Appeal dismissed Oct 2009
11. Appeal rights exhausted Nov 2010
12. Graduated from UK university with a BSc
13. Married to a British citizen August 2011
14. Applied for FLR(M) Nov 2011
15. Refused Jan 2012 with no right of appeal

MY question is if I go home to apply for entry clearance what are the chances of me being denied as I have been accessing NHS treatment.

A complicated immigration history such as yours almost certainly requires good legal advice.

I assume you already have an immigration solicitor so what has he/she said?

I have and they have applied for a reconsideration; however I am worried that I am just wasting time and waiting when I could have a quicker decision by going home but am worried about the repercussions of accessing medical care on NHS to my application.

Lawyers would probably milk it in terms of fees and give you hope and will say that they will fight your case, though you've clearly lost a couple of times. If you go home then you will probably be looking at least a year before you can come back as I know of a couple where the wife got BC but the husband was overstayed for 13 years or so. Both had to go back and were able to return after a year. Good luck.

Thank you very much its just that you really don' know if a solicitor is just saying so because they want your money or they can actually represent you properly. A year seems to be very long time to be away from my husband though.
