Hello everybody

My Tier-2 visa was issued in 1-Sept-2009 for 3 years and 1 month. It expires soon and I will apply for extension with another employer (unrestricted CoS).

My question is the following: will I be able to work for my new employer from 1-Sept-2012 (i.e. when my current contract expires) or we will have to wait till 1-Oct-2012 (i.e. till my current visa will expire)?

I have to arrange this issue soon, so any suggestion is very much welcomed.

If you change employer you must make a change of employment application - see the Tier 2 policy guidance, clause 189, and this must be preceded by your new sponsor/employer assigning a new Certificate of Sponsorship to you. The new CoS will have your work start and end dates noted on it. You cannot start work for the new employer before the work start date stated in your CoS.

You will have a new visa issued following your change of employment application.

Your present visa only entitles you to work for your present employer as it has your present CoS number noted on it. Your present contract and permission to work expire on 1 September. You are allowed to stay in the UK until 1 October but are not allowed to work from 1 September to 1 October UNLESS your new CoS and visa allow you to.
