Hi Senior members,

Please could you answer my queries.

I have ILR in UK and my wife is currently on dependant visa of a Tier 1 (my last immigration status) which is expiring in the next couple of weeks, thus I am applying for her extension using FLR (M) form.

Sadly I recently lost my job and thus have applied for jobseekers - contribution based, council tax and housing benefit only in my name (as I am aware she is not eligible for benefits and have declared that on the benefit application form). I am still waiting for my claim to be processed. She does not work and thus we have no income at the moment.

I have about 5000 GBP savings in the bank and thus am planning to use third party support from a family friend in UK for the application. Our friend is happy to support us by giving us 750 GBP per month until we find a job and become self sufficient again.

QUERIES:

1. Is 750 GBP per month going to be sufficient to meet the maintenance and accommodation criteria?
I am currently living in a rented property (1 bedroom apartment) with with rent of 550 GBP per month.
I have assumed that 750 GBP would be ok as I would be able to get the HB and CTB along with job seekers (67.5 gbp per week) and 550 GBP would be covered by HB and 750 GBP would be sufficient to support my wife.

2. Would I need to submit my benefit award letter with the application or they are not necessary? I ask because my claim is still being decided and thus it is faster for me to apply without waiting for the benefit letters.

3. I am submitting my last 6 months salary slips and bank statements along with P45 to evidence 5000 GBP.
Also I am submitting my third party friend's 6 months salary slips and bank statements and a letter from him to say that he is happy to support us by paying 750 GBP per month if we need it (as I don't need it just now given I have 5000 GBP in the bank) and until we find a job and become self sufficient again.
Do I need any other document from my third party friend and is the conceptual wording of his support letter sufficient ?

4. Do I need to show 750 GBP transaction from my third party friend's account into my account or a letter from him to that effect would suffice? I don't need the money just now as I have 5000 GBP in my account to care for me and my wife for the moment.

Hi Drabiz,

I'm not a senior member but I'm just gonna answer according to my knowledge.

Your situation is a bit complicated, in my opinion, for the fact that the UKBA specify very clearly that you should show maintenance funds enough to cover you and your partner for 2 years (based on your lifestyle, I think), without the need to resort to public funds (jobseekers, housing benefit etc).

If I was you, I would definitely seek for a immigration specialist lawyer to help you with your application.
