SEGS to Tier 4. Is PSW now possible?

Hi,

Apology if it has been asked before. I came to UK for Bachelors degree in 2004 and got SEGS in 2007 (1 year) which then expired on March 2008. I went back to my home country and then came back on Tier 4 visa in jan 2011 for Masters degree. I have now got my degree from university.

Can I apply for 2 year PSW?

if not Can I apply for 1 year PSW under transitional arrangements?

if you care to read those rules you will see that it is not possible. In particular 245FD f (vi)

245FD Requirements for leave to remain

f) The applicant must have, or have last been granted, entry clearance, leave to enter or leave to remain:

(vii) as a Tier 4 Migrant, provided the applicant has not previously been granted leave as a Tier 1 (Post-Study Work) Migrant or in any of the categories referred to in paragraphs (i) and (ii) above, or

(The categories referred to in paragraphs (i) and (ii) are Fresh Talent, SEGS and IGS)

(g) An applicant who has, or was last granted leave as a Participant in the Fresh Talent: Working in Scotland Scheme must be a British National (Overseas), British overseas territories citizen, British Overseas citizen, British protected person or a British subject as defined in the British Nationality Act 1981.

Basically I think it says, if you have had SEGS, you can only get Tier 1 PSW by switching directly from SEGS into PSW. You will also be required to satisfy the conditions in (g). You will not meet the requirements if you do it through any other route.
