break in job or break in continuity of stay in UK for ILR

Post by jasba » Wed Nov 08, 2006 3:58 pm

Hello there,

I would like to know whether at the time of application for ILR does the HO considers a break in jobs/employment of more that 3 months to reset the count for 5 year ILR or does the HO considers whether the individual was continously outside the UK for a period more than 3 months when switching employments under both WP and HSMP applications.

The reason of confusion is the new guidelines of HSMP application states that "71. To qualify for settlement in the UK you must have spent a continuous period of five years in the UK in a category leading to settlement...... except for short holidays or business trips"

Replies would be highly appreciated

Earlier many people with well over 3 months gap qualified for ILR.
But now the rules are changing faster than water flows in Thames.
So rest assured that 3+ months gap will break the continuity.

Better don't expect getting ILR anytime. In that case you can feel sorry to a lesser extent. HO is a cheater.
