Yes, she does qualify. She has always worked and we have lived together the whole time. Confused though because HO told me to apply in October 2012.

I am thinking to apply through solicitors, just to make sure. Cannot wait!!

The key thing is have you lived in the UK for 5 years (legally) and did she work in the UK for 5 years. If that's the case you can apply now.

I had been in UK on student visa from June 2004 - Oct 2006. I then went back home to only return in March 2007 on a Visit for Marriage Visa. Got married in May 2007, applied in June 2007 and got the residence card which now expires in Oct 2012.

Now, will my few months on Visit for Marriage Visa count towards my 5 years legal residence? Will my years as a student count at all? Can the 5 years residence strictly mean the 5 year on residence card as EEA Family member?

My wife can prove that she has been using her treaty rights, as she has worked continously. What will HO need from me?

I am confused because on the phone, HO is telling me to apply in October 2012 which I rather not, because I need to travel this coming November.

Hi anp,
If you are married from May 2007 and lived together in UK and your wife exercised her treaty right throughout 5 years(with evidence) then stop hesitating and just apply for it, you do qualify for PR, good luck
Bare in mind,,,,HO staffs not all the same with the knowledge :)

Hello, i thought i'd share my timeline aswell as have gained from people's stories/experience so therefore decide to include mine so people can benefit from it

EEA4 Application sent: 1 december 2011 (6 weeks early)
Application received by HO: 2nd december 2011 (special delivery)
coa received: 24th december 2011, dated 21st december 2011
Passport requested on 18th january 2012 for course enrolment
passport received on 25th january 2012 by special delivery included (small one)
sent email to HO requesting status of application 16th mar 2012 @ 11.26am
received reply from HO stating documents is held within despatch department @ 13.21pm
Pr received: today 22nd mar 2012
pr dated: 8th mar 2012.

special thanks to bobobo and to other members of the forum, goodluck to everyone.

Hello, I thought I'd also share my timeline because I received my permanent residence (EEA4) in just over a month! I hoped it would be quick but this must surely be record-breaking.

14/2/2012: EEA3 (my EEA husband) & EEA4 (me) application sent
06/3/2012: CoA received for EEA4 application
10/3/2012: PR for my EEA husband received
21/3/2012: PR for me

This was actually our second attempt (our first application unsuccessful due to insufficient evidence of employment) and my previous residence document had expired last summer. I wonder if it helped fast processing or just pure luck, but I am just so relieved :D

It sounds like the original application was incomplete and that additional evidence was requested. You therefore may not have had a rejection. Your "second" application was a continuation of the first. Anyway no matter you have it now.

Hello evry one i complite 5 year on 06.06.2012 I DID marred on this day bur my card vaild till 13.05.2013 can i apply befor that date or i have to apply on or after that day please some one let me know thanks very much to evry one its great board i get many info here

On 06/06/2012 you qualify for PR as long as you meet the requirement.

Thanks, i sent them an email to this email address LiverpoolEuro.PassportReturns@UKBA.gsi.gov.uk to get an update on my application and got a prompt reply, gdluck mate.

14/02/2012: Application received by HO
07/03/2012: Passport requested for urgent business trip
12/03/2012: Passport received together COA in same envelope

Does anyone have any experience with regards to sending the passport back for the visa to be attached? I have seen from some timelines that the passports were sent back to the applicants but not that they were ever again requested back by the HO.

Hi guys, it has been almost 5 weeks(by end of this week) when I applied for PR (HO received on 27/02/2012) and I haven't heard anything yet (no COA),,,,, should I write to HO( an email) or wait longer? it's killing waiting with no response from HO.
Is anyone out there been waiting longer than 5 weeks,,,thanks
If I have to email them,,,,,what should I write exactly?
Just to let you know I have applied through my solicitor.

Refusal received on 16/08/2012 dated 11/08/2012
At the court, the HO REP withdrawn the decision and asked me to send the DOC for the time before marriage.

I, e-mailed HO and asked if they can Confirm they received my Application and secondly how long does COA normally takes and they replied within hours, will soon be despatch. good luck mate

Hi zubby007, thanks for your response but I had already emailed them today morning at 10:01 exactly(and I was very polite),and you said it only took few hours they respond you, I asked them if they have received my application and how long it take to send me COA?,,,,,guess what? follow my next message :)

As I mentioned it earlier I have emailed HO only today at 10:01 and I got reply at exactly 16:59 and this is what they write,,,,

I know that my wife (eea national) has to prove that she has been excersing the Treaty Rights such as residence and employment, and that we will need to prove that we have lived together. All this should not be a problem, as we have been living together since we got married.

Yet, will I need to provide anything on my behalf, such as proof of employment, etc??

No proof of employment for non-EEA national required.
