applying fresh again for extension

Dear ALL

I am asking on behalf of my friend ,

1.His visa was refused on basis of CAS cancellation by the college .But again the college reissue the cas , the case is still pending with the tribunal , can he apply fresh at the same time . and does he come under the category of established presence or he has to show funds as new comer,(visa expired in the month of Dec .

Any suggestions appreciated...
