ILR RELATED TO WORK PWRMIT

Post by ARVI » Mon Apr 02, 2012 8:48 pm

Hi
I am very much new on these forms, after reading few thing found its very helpful for those specially who are climbing on ILR ladder like me and specially thanks for those who provide there valuable experience, suggestions and guidance to all who need them.I need some help in my case .
I was in UK from 2001 to 2007 as student and I got the work permit in 2007
I am thinking to apply my ILR in June 2012 on work permit basis
I got entry clearance on WP basis on dated 24 July 2007 which was initially for 9 months only.
WP extension from same company while in UK before previous WP expires for next 5 yrs until 12 June 2013.

will I be eligible for applying ILR after 26th of June 2012?

My husband and children arrive in UK as dependent on 16 Sept 2007.
Both of my kids born in UK(one in 2002 and other in 2007).

Can I and my husband initially apply ILR together and my kids then be eligible for UK nationality /passport registration if we will be granted ILR?
I have some gaps from 2003 to 2005 as well.

Yes, you can apply for yourself and husband only. After ILR, apply to register children under MN1 if they were born in the UK. Your absences in your student days do not count towards your work permit qualifying period

good luck my friend.

So work permit qualifying period from the 24 July 2007. Five years from this date is 24/07/2012. You can apply for ILR 28yrs to your "five years" date. that means you should be eligible to apply from the 24/07/2012 - 28days = 26th June 2012.

Your children can apply for citizenship the next moment you will get yours ILR, if they are born in UK as mentioned by you.
But you and your hubby will get it after one year of ILR.

is it possible after one yr of ilr where the main applicant does not want to apply uk passport but dependent wants to and dependent will get their uk passports without applying the main applicant who was involved in ILR as main applicant.

while reading on ukba website i could not understand few line written underneath
"Period between grant of entry clearance and date of entry uk can be counted towards 5 yrs provided this period was no longer than 3 months."
In my case entry clearance issued to me on 18/07/2007 and date of entry uk is 24/07 2007.

what can be earliest date for me to apply for my ILR.

pls suggest

This instruction only refers to when a CW may apply discretion due to late entry, which is not your (straightforward) case.
In my case entry clearance issued to me on 18/07/2007 and date of entry uk is 24/07 2007.

24 July 2007 + 5 years - 28 days = 26 June 2012.

online slots are release for 42 days time window. but if you want one then you should aimed 42nd date from today (appointment will disappear soon ).

you can target 5th June if you are looking to book today night(midnight) or tomorrow early morning. you need to get the appointment for 2 people.

If not travelling and children's leave expires in June 2013, then including UK-born children in ILR application will be a waste of money.

Hi, I am pretty much confused about the ILR eligbility period. My work permit is valid until October 17, 2012. However, my entry stamp to UK is on November 5, 2007.

Considering the fact that I can apply for ILR 28 days before 5 years completion from entry, my eligibility to apply for ILR will commence from October 8, 2012. Personally, I find it to be too close to my visa expiry date, which is, October 17, 2012.

In this case, will I be able to apply for ILR 28 days before my visa expiry rather than my entry date?

Unfortunately, the Solicitor that I consulted was wishy-washy on this. His argument was that the most compliant way is to apply from October 8, 2012, but he also stated that it is possible to apply from September 19, 2012 (i.e., 28 days before visa expiry).

Your solicitor was right -- you need to apply from October 8, 2012, as you have enough time left on your current visa (if you apply in person you'll get decision on spot). Don't try to play HO your own game -- play according to their rules, an you will be fine...

Precisely the date "when you last entered in UK". What is your problem with answering this question?..
