I want to regulate my partner's status want to get advise and info.

1)She has overstayed her student visa for more than a year.
2)We leave together for nearly 2 years
3)We have a 1 year old child
4)She's working before her visa expired and payed taxes
5)She's stop working after her visa expired
6)Her Bank Account was closed (passport account)
7)I am working fulltime and payed taxes

She will apply for partner's visa,is she can take an English test here in Uk eventhough she's an overstayer?Is it possible that she can apply for a partner's visa inside the UK or she need to go home to apply?but the problem is our son is still breastfeeding and i am working fulltime and no one will lookafter my son if she will go on her country to apply.Can i get a british passport to my son eventhough his mun is an overstayer?

Did your partner still have valid leave for the UK when she had the baby? Did she have the baby in an NHS hospital or obtain private medical care?

So how long does it take(processing time) if she will apply to her country?

When she got pregnant she's still have a visa and registered to gp and hospital.

The main requirement for an unmarried partner visa is that the couple have lived together for two years in a relationship akin to marriage. You need documentation to prove it, such as rental agreements, bills, bank account statements, ideally with both your names on the documents. If you have lived together for less than two years you are likely to be refused, even if you have a child. You might be better off getting married and applying for a spouse visa. I think your partner would still need to return to her home country - she can apply for a fiancee visa and then return to the UK to get married. I don't know whether the fact that she has overstayed makes a difference - hopefully someone else can advise.

If during her overstay, she used the NHS and did not pay her whole bill off in full, she will be refused a visa (if she used over £1,000 worth of services). Keep that in mind.
