English langauage Test

Post by eksbee » Sat Apr 14, 2012 9:30 pm

I need some help regarding the english langage test

Could somebody please provide opinion/confirm if the test is mandatory for Spouse Visa application. As I am getting conflicting information from the guidance notes.

I am a UK National with UK Passport. My Fiance is a Tanzanian National with Tanzania Passport.

The guidance notes found here: http://www.ukba.homeoffice.gov.uk/sitec ... icants.pdf

They state that:

An applicant will need to meet the requirement if they are:
- a national of a country outside the European Economic Area and
Switzerland; and - YES SHE IS OUTSIDE OF EEA
- in a relationship with a British citizen or a person settled here; and
- applying as that person’s husband, wife, civil partner, fiance(e), - YES SHE WILL BE MY WIFE WHEN THE APPLICATION IS MADE
proposed civil partner, unmarried partner or same-sex partner.

The above suggests that she does require the test as she falls into each category listed.

Further down in the guidance notes document it says:

The new English requirement does not apply to the following groups of
applicants:
- spouse or partner of Tier 1 and Tier 2 visa applicants
- spouse or partner of a student
- visitors
- refugees or spouses of refugees applying on the basis of family reunion
- dependent children
- spouse or partner of an EEA national
- spouse or partner of a member of the armed forces applying under Part 7 of the Immigration Rules
- applicants for indefinite leave to remain

As am I am a UK National/Citizen EEA national does she require the test?

Or have a misunderstood the statements.

Does Anybody know anything about applying for UK Spouse visa in Tanzania?

Many Thanks

Hi

She will need to do the test. EEA National refers to European Union citizens and the EU freedom of movement for EU members and non EU families and associated rules in relation to the EEA Family Permit.

As you are a british citizen, the UK immigration rules apply as she will be settling in the UK. These are different to EU rules.

Hope that helps but am sure members with more detailed knowledge will respond.

Thanks

Char
