EMC2 wrote:Hi,
Thanks for your last email.
Please could someone let me know that how many days a person on spouse visa can stay outside UK?
My wife will be visiting her parents for 4 months in Pakistan this summer. This is her first out side Uk trip after getting her spouse visa in Dec 2010.
All your help will be greatly appreciated.
Regards

Scenario.. as per my signature I am still waiting for a response, but say inshALLAH I receive a response on 1st May
Husband will come for 10 days to see me and then will return back by 30th May and then will be studying for the whole of June and July (2 months) when we go to apply for his ILR which will be say August 2014 (assuming 27 month visa) and we provide evidence of his completion of studies.. would I need to submit an extension for his visa or do you think I could apply for ILR
So I am working on the Scenario and logic
Visa stamped 1st May 12
Out of country 3 months (give a month the year after for hols)
ILR appl 1st August 14
Thanks for your help
TIME SPENT OUTSIDE UK
It is very technical point;
UK law states: Immigration rules do not restrain anyone to go outside UK. It relies on merit, e.g. whether you travelled together and lived together outside UK.
In a nutshell; if your wife spent majority of the period overseas or in Pakistan, there may be reason to doubt that all the requirements of the rules have been met. Moderator Batley Khan pointed out 90 days. And more importantly, she must have spent no more than 90 days outside the Uk in the last 12 months.
@ Batley Khan will confirm this as well.

I am not stressing myself out over this status change thing, I am just waiting pateintly for the day my hubby gets his visa granted and the day I will get to see him at Manchester Aiport. That is priceless comapred to continous worries over whats happening with the visa.rihsabramo wrote:Anyone applied in Mirpur, applied on 1st of March and it's been under processing at BHC for a month with no status updates!
What Allah SWT has decreed for us, will happen and none can change it without Allah SWT's will.
Everyone, stay positive and keep smiling even though I know being away from your loved one is hard enough. A little bit of encouragement and motivation from to all the members here.
