single, consecutive 12-month period during the 15 months

Post by golu » Wed Apr 18, 2012 1:30 pm

hi,

According to the guidelines an applicant can claim earnings points for a single consecutive 12-month period.

My case is I have last May and June salary and payslips. I dont have one for July and then I have from August to this April.

Can I claim points for May and June 2011 and then August 11 to April 12 ?

Or does single consecutive 12-month period mean I can only claim earnings for August 11 to April 12 ?

Kindly reply

As long as they are all within a 12 months period, you can do that. The earnings you are claiming could also be from multiple employments.

Linkers buddy are you sure?

This single consecutive 12 month period sounds bit awkward to me, as in if I split it in two May-June and then August to April'12, it technically is not a single consecutive period..Let me know what you think

You will be ok and that is not a problem.

I have applied for an extension in similar way and did not have any issues...as long as they fall in the 12 month period you are ok.

The way I interpret the 12 months consecutive period is.

you can omit a month or more i.e. no income/salary for that month as long as start and end dates of earnings period makes up one full year (if you are claiming for 12 months that is).
If the earnings period is less than 12 months that is not a problem.

So you can exclude a few months as above, but what you cannot do is show income for first 3 months, take a break for another 3 months and then ask UKBA to include your earnings in last 9 months.
Information and/or advice provided by me is of general nature and is not intended to substitute for informed professional legal or other professional advice.

Linkers buddy, it does clarify the doubts, I will claim for the single 12 month period, although technically I will be claiming only 11 months out of them 12 months.

Thanks rshelar and nnj10
