ILR Waiting For Over 6 month

ILR Waiting For Over 6 month

Hi,

I and three dependent(wife and two kids) applied for ILR on 18th october 2011 under WP+Tier 1 (SET O)and uptill now, no response from UKBA. The only response I get when I call them is you have to keep waiting. They cannot tell me why I need to continue waiting and for how long. The painpful part is that I had to extend my expired Tier 1 for another 28 weeks(paid £2500) and then pay additonal £2430 for ILR. I spent a total fortune of £4900 and yet still waiting after 6month. Cannot travel, plan

I do not need to recount my woes for the absence of my passport and the frustration inside me is unmeasurable. I am sure there are veterans who have manage this sititation. Can anyone in the house please help me with advice on what to do.

ZAS,

I can understand the psychological effect of this on anyone who has gone through this sort of thing before. But don't be bothered as there's little you can do to change it now except you want to withdraw your application from postal to premium service, repay the full premium charge and loose the fees you've paid for the postal. If your application is straight-forward, I believe you will get your decisions in the next few weeks. So relax and enjoy yourself with your family.

I waited for almost 5 months after posting my application and whenever I call the HO, they say application is under consideration. And finally came back to me after 5 months. But the rule is that after 6 months of waiting, you can call HO and if no positive response, tell them to transfer you to the "urgent team" and also request for their email address so that you can write to them explaining your case.

ILR Waiting After 7 Month and HO Lost My Documents

Dear All,

After consulting in this forum with advice from 1971, I wrote a 3rd Expedite letter to HO for my ILR application which has been outstanding for 7 months now. I also spoke to my MP who also spoke to them. Behold “god” spoke.

Home office called me for the first time in my existence to ask me of my documents, which I sent them evidence of posting and signature of receipt by Home Office. After waiting for another 2 weeks, They now call to say that it is likely my passport is lost and that they will start the process of compensation.

In my application I have four passport, Birth certificate obtained outside UK, My First Degree certificate obtained outside UK, Pay slips, etc all originals as usually demanded by the “gods” Meanwhile for all this period I have been calling them almost every two week, they keep claiming my application is been considered.

In the event my passport is lost, they want me to apply at my Embassy for another Passport and chase my previous employers for another Pays lips. I am a contractor who get paid an hourly rate, chasing those document is a significant lose to me.

I do not want their compensation as they cannot provide it, having deprived me of life changing opportunities by withholding my passport for the last 7 month. However in the event the worse case happens and they confirm losing my document. What can I do and what are my rights?

I will appreciate you kind response, Please help!!

Do you know what all they have lost? Passports and payslips only? Or all the documents?

1. Given that the passport(s) are lost, you'll have apply for new one(s) from the embassy of your country. I guess there is no escaping that ....
2. Request your employer to issue a letter confirming your salary payouts.
3. It may be wise to request bank statements from your bank for the 12 month period.
3. Not backdating the ILR shouldn't be a problem for you .. in context of applying for citizenship ... there is discretion possible in such cases.

Make it very clear with UKBA that new passports and evidence of economic activity is what they need to consider your application ..... and nothing else.

And if you are not happy with the amount of compensation UKBA offers you for your monetary loss and emotional trauma, get the Ombudsman involved.

Many thanks for responding and comforting to hear about the discretion.

All the documents(mine and 3 dependents) sent to them were confirmed lost, including 8 passports, Degree Certificate,Birth Certificate, Marriage Certificate, Company Account Statements, Biometric Residence Cards etc.

From your knowledge, what level of compensation should I expect from them other than expenses of replacing my documents?

My biggest concern is the loss of income and trouble of taking 2-3 weeks unpaid leave to get a replacement document as my embassy do not issue a replacement of electronic passport.

Dear All,

I have finally got my ILR on Immigration Status Document as my passport is missing.

I have had to travel back to my country to get a new passport which I have to send to UKBA again.

I have also send them expenses incured and income lost and I am waiting to see if they will reinburse.

Any one has idea what sort of copensation one is entitle for lost of passports, education certficate.
