I'm weighing up my options now.

Appeal, could be January 2013 before I see my wife if I do that. Visit VISA to the UK, quick response in comparison to settlement applications but only valid for 6 months, headaches after 6 months and very expensive if you keep applying.

Think I'll appeal and go Pakistan twice in this period to stay with my wife since I can afford to do that.

they usually dont give u a visit visa if a sttelement one has been refused coz they dont see that u as in ur wife has many ties bk home.

i am sure the ECM will overturn this decision, ur refusal issue isnt a complicated one. ECM can take 18-20 weeks max (once uve submitted ur appeal) to review the case.

Syma,

Could you explain what process you followed in the appeals procedure?

Did you submit only docoments covering their refusal reasons, or did you submit documents covering everything, ie. new bank statements, new wage slips, cause it's 4 months near enough since the original application.

first off the appeal is now submitted in leicester UK not Gerry's, calculate 28 calender days from the day u recieved the refusal thats ur deadline to submit the appeal. u should get your wife to send u a scan of the refusal letter read it carefully to see whats points have been raised.

i only submiited documents relevant to the refusal points, u dont submit evrything again. for instance if u wre ONLY refused due to the nikahnama not being registered u'd submit the following

-the appeal form iaft2 ( explain in detail how & why the nikahnama was not registered in section 3D of the form)
-copy of refusal letter
-registered & endorsed nikahanama ( i think its ok to submit a copy but please double check)

i think thats it but make sure u get the refusal letter and read it urself the wording in it matters alot. for instance have they just questioned the registeration of nikahnama or they are wondering if the marraige isnt a real one u know what i mean.

@king2b98 really sorry to hear ur mrs visa has been refused. plz keep ur head up...i know how u will be feeling right now. Keep faith in Allah just do what u got to do now. no matter what at the end of the day ur wife will be here. just a matter of time. if u appeal then they may overturn the decision as it was refused only due to the nikah nama not being registered. means all other ducuments are fine. just remember Allah n he will help u thru this

Thanks Syma,

The refusal reason:

Your nikah nama has not been registered with the Union Council, I therefore conclude that your marriage is not a genuine one and I have rejected your VISA application.

I am speaking to my father in law and my uncle in Pakistan, who will give one serious slating to the Imam and his guys for not registring it officially if it isn't already. Then it's a case of them submitting the correct docs to me.

ur welcome, i just checked on my nikahanama make sure u have the following clearely written in the write places;

the serials no: on the first page
register no: again on the first page

also i jus rememebered u'd need to submit a new translation of the nikahnama with the a letter from the translator dating it and saying its a true translation of the original.

I'll be fine, as you all know I'm a fairly laid back and patient guy, it's my poor wife I'm concerned about.

I'll sort out a holiday plan I'm sure, I can figure something out. But I'm more concerned about this whole appeals process.

What's the fees, where do we get the IAF form from?

I've still to have a proper conversation with my wife, will wait until she gets home and I get home to figure something out.
