URGENT: UK EXPERIENCE POINTS

Post by kingbobby57 » Tue Apr 24, 2012 12:12 pm

Dear All,

I have a confusion after going through the T1-General-Guidance.

Here is my situation:

I made my initial application in INDIA in March 15 2009, I did not claim UK experience points as I was not eligible as I was in INDIA.

Now, in MAY 2012, I will be applying for extension here in UK.

Q: Can I claim UK experience now while applying for an extension, which I had not claimed in my initial application.

From T1-General_guidance :
UK experience
Claiming points – initial applications only
121. An applicant should read Appendix A,
tables 2 and 3 and paragraphs 12, 31 and 32
of the Immigration Rules.
122. An applicant can claim a maximum
of five points if he/she has scored points for
previous earnings and those earnings were
made in the United Kingdom.
123. We will only award points for
United Kingdom earnings if the applicant’s
immigration status in the United Kingdom
legally entitled him/her to be in the United
Kingdom and work here throughout the period
during which the earnings were made.
124. Applicants should note that the
available points for UK experience differ at
extension stage depending on what date
they first successfully applied under Tier
1 (General) or the Highly Skilled Migrant
Programme (HSMP).

I AM CONFUSED, AT THE START OF THE UK EXPERIENCE in guidance,
IT SAYS: "Claiming points – initial applications only" I did not understand this.

Thank you for the reply,
But, if you see the guidance, it says, INITIAL APPLICATIONS ONLY... with this statement I am confused...

Does anyone applied for extension claiming UK experience who had not claimed at the time of initial application ?

what stops you from reading the guidance further:

124. Applicants should note that the
available points for UK experience differ at
extension stage depending on what date
they first successfully applied under Tier
1 (General) or the Highly Skilled Migrant
Programme (HSMP).

and more under same heading, which makes it clear that extn applications get UK experience points also

I agree and I have read point 124.
Then, why the statement "Initial applications only" ?

that only uk ba can answer. its certainly not the first misleading/confusing point made by them. the points calculator help window pop-up confirms that you can claim uk exp points during extn

Thank you for the reply.
I need to claim UK experience points, else I wont be eligible.

I also agree with claiming UK experience, want to double check.

If anyone already applied for an extension with UK experience points here in UK who initially did not claim when made application first time in INDIA.
