Divorce

Post by sheikhatherali » Fri Apr 27, 2012 11:29 am

I'm a Pakistani national, arrived here in UK late Feb2012 on Tier1 visa, with my wife as a Tier1 dependent, we have been married for 7months only,

My wife cheated on me and were sent back to Pakistan late Apr2012.

Now i need to give her full divorce and wanted to comply with UK and Pakistani laws so that the divorce will be acceptable later.
could anyone please let me know the process.

Current status is I'm in UK and my wife is in Pakistan.

- Do i need to open a case with UK court?
- An initial notice of 90days (with expenses) with attestation from Pakistani Embassy in UK to my wife would be enough to start?

Any advice in this regard would be appreciated.

UK law doesn't allow a divorce for anyone married less than 1 year.

You wouldn't be able to do it UK. You both need to be in the UK for past 12 months in order to file divorce but in your case you have been here for only 2/3 months.

Seek advice from a solicitor specialising in family law.

If you are married for less than a year you opt for Judicial Seperation http://www.terry.co.uk/divorce4.html
