he could be fine depending on how you look at it. Regardless of which date he gets his salary paid, I assume he is paid on a monthly basis, i.e. he gets paid on 27th March for 1st to 31st of March. If this is the case, he can claim salary for period 1st July 2011 to 30th June 2012 (which will be a 12 month period in the last 15 months) if he is applying on 2nd October 2012. He /she can apply whenever they want. UKBA suggests that the application is made not earlier than 5 weeks of visa expiry but there are no definitive timelines. He / she can apply even 1 year in advance but the only issue is he / she might fall short for ILR.helloimran wrote:What a quick and understandable response

If his visa expire on 29/10/2012,so he can apply any date after 17/09/2012 to avoid,fall short for ILR???
