Time outside UK for dependant

Dear all,

I would like to know, can 'Dependant' of Tier-1 General person stay outside UK for any number of days? I mean for example, after getting Tier-1 dependant extension done, spending approximately 8-9 months outside UK and then coming UK. Does it or will it affect ILR or any other further visas?

Any help will be appreciated.

There won't be any problem for ILR I guess but citizenship might get delayed.

There maybe some problem when applying for indefinite leave to remain. You will have to show 2 years of been living together in the UK in marriage or civil partnership, or in a relationship similar to marriage or civil partnership

I have been married for more than 2 years now and we have already spent 2.5 years in UK as married couple, wife might go to India for her delivery for may be around 8-9 months in total, hence I was worried whether is it acceptable or not? MY ILR will be in 2014. I will be doing tier-1 Gen extension now.

Should not be a problem as per the current rule. There is no mention of the 2 years need to be continuous.

I have slightly different scenario.

I have completed 5 years in UK and my wife is staying with me from more than 2 years. We are applying for ILR this month.

We a had a baby born in UK and he hasn't completed 2 years yet. Also he stayed in india for 6 months with my parents.

My question is whether he will get the ILR or he will be dependent of us?

Could you please help as the application date is coming near

AFAIK any child born in the UK and if their parents contain ILR, the child becomes eligible for ILR as well

I had my sister in law who had a 6 mths daughter when applying for ILR. All of them applied together. ILR granted.

Dear All,

First of all many many thanks for all the help been provided on this forum. I had stressful time right from begining as getting an appointment was so difficult then bank statements etc. but finally I got Tier-1 Extension done successfully now till June 2014.

Thanks for all help,,appreciated.

I have big decision to make now. Our baby is due in Nov 2012 and me and my wife in little confusion over time spent outside UK.

My wife have already spent 2.5 years on Tier-1 Dependant in the UK. So if she go to India for say approx 7-8 months, will it affect ILR application?

Also would like to know, baby born in the UK and in India what would be benefits and disadvantages of the it?? How the things will work for baby?

It will be very helpful if someone can shed some light please.
