I was made redundant on 20th July but my wife supported me and I had my savings. I couldn't secure any job as my visa was about to expire on 29th Nov 2011 so sent the details, my and my wife's payslips, our bank statements and other details.

Now I can't even switch to spouse visa as the leave I've been granted is outside the immigration rules.

Its really not fair! I always paid taxes, never claimed any benefits and after all the wait and 14 more days to become 6 months, UKBA declared that I can't have my ILR!

I'm devasted ...
Hi May I ask what is Discretionary Limited Leave ??? and why did they refuse it ?

Hi, I am really sorry to hear that, that truly is unfair, if it's only because you were out of work for couple of months. Stay strong, something will come up, it's important your wife is there for you! I've been in the same situation when I first applied for spouse visa and that rejection really hurt! I know exactly how you're feeling. Talk to a solicitor, see if you can complain or anything, look at your options. Just don't let emotions win over. Good luck and stay strong!

Finally !!

Received Passport with ILR Stamped SET(0) exactly after 6 months.

When i called up the HO yesterday morning, they said it was posted on 26th April by second class post.I guess they lost my prepaid envelope some where in between.

Details:

Submitted on 1st Nov 11
Acknowledged on 3rd Nov
Stamped at Manchester office on 29 March 12
Received on 30th April 12

Mine was a case of WP+HSMP+Tier1, so may be not as straight forward as others.

Thanks all for the moral support and help through these troubled 6 months.
Will keep following the forum and will be glad to be of any further help.

Letter dated 03 April 2012

Documents received by 2nd class post from Liverpool.
My address has changed since the application was sent and I had notified the change of address via a registered letter as well as on online change of address form on ukba web site. The covering letters accompanying passports have the correct new address but the envelope was posted to the old address where a postal redirection is in place.

Strange that on 25th April the application was still under process!

It has been a long wait for me and I completely understand how you feel waiting for news on the ILR application. I sent my application on 29 Dec 2011 and am still waiting to hear from UKBA. Like some of you, I did not receive any acknowledgement letter although UKBA was really efficient at deducting the fee from my bank account rightaway! My address has changed too and to hear actual evidence of UKBA messing up addresses is disgusting.

I actually have travel plans end of this month but looks like I will have to delay it now :(

To those of you who are still waiting, best of luck!!

i've passed the interviews and now im waiting for the outcome before i break the news to them .. the job does start until early june .. still have hope ill have my passport by then


Mi May-Marie, I am the same, I just got a job offer earnnnig much more and and I have nothing to prove that I can work here (also my job in my current place ends at the end of the month). Did you get an offer, what did you tell them about you rcircumstances, how did they take it? I haven't said anything to them yet, but I'm supposed to let them know soon and I reallyu need the job because my husband is not working.

Any light on this will help me tons!

I applied in mid October 2011 and I'm still waiting after 6 months and 2 weeks. Nothing we, our agents, solicitors, MPs can do except wait patiently until we receive our passports back. I think initially we wind ourselves up after 3 months but the longer it gets, the more we just have to surrender to the fact that no matter how much we try to speed things up, the UKBA works at their own pace. I think they get more irritated with people who chase them up before the 6 months is up.

But there's nothing to say that an MP's letter won't prompt them to look at an application if it's been over 6 months. The other thing I realised is that the MP's Liaison Unit is based in Croydon but from my recent call with them, I get the impression that the staff there has no idea where our applications are and who is dealing with it nor are they able to contact their colleagues or locate the specific caseworker. As a national agency, it doesn't seem like they have an internal system of logging who or where the applications are. Perhaps some have been lost in the post and is floating somewhere at a Royal Mail dispatch centre?

R&F, although you are still legally allowed to work while your application is being processed, it's up to you to convince your potential employer that your ILR will be approved and that they take that risk on when employing you. If you went through a recruitment agent, they might be reluctant to pay the agents fees just to find out that your application has been refused after they spent all that money on you.

From what people has been writing on this forum, it seems like the turn around time is about 6 months. I hope this doesn't hinder your opportunities too much depending on when you submitted your application.

i've passed the interviews and now im waiting for the outcome before i break the news to them .. the job does start until early june .. still have hope ill have my passport by then


Mi May-Marie, I am the same, I just got a job offer earnnnig much more and and I have nothing to prove that I can work here (also my job in my current place ends at the end of the month). Did you get an offer, what did you tell them about you rcircumstances, how did they take it? I haven't said anything to them yet, but I'm supposed to let them know soon and I reallyu need the job because my husband is not working.

Any light on this will help me tons!

R&F, although you are still legally allowed to work while your application is being processed, it's up to you to convince your potential employer that your ILR will be approved and that they take that risk on when employing you. If you went through a recruitment agent, they might be reluctant to pay the agents fees just to find out that your application has been refused after they spent all that money on you.

As it is, I was offered the job I was hoping for, the thing is I worked for them before during my definite leave to remain and I think they just assumed and they never asked about my visa situation. The job doesnt start until the 4th of June so I have big hopes of having my passport back by then. If not I will have to convince them that I expect to have my passport soon enough and that I do not expect any problems ect... I was given a hotline phone number by the HO that will tell them that I am allowed to work in the UK .. so I hope that will help but im not too worried either.

I was also offered an other job, they were fully aware of my visa situation. they didnt seem to mind as long i was able to prove my NIN so its not impossible to find working in this situation !!

PEO - 13/04/2012 - Turned away on the basis of Limited Company cannot be assessed by the case workers at Glasgow PEO. Couldn't secure another PEO, who could assess.

Its really not fair! I always paid taxes, never claimed any benefits and after all the wait and 14 more days to become 6 months, UKBA declared that I can't have my ILR!

Hi, I am really sorry to hear that, that truly is unfair, if it's only because you were out of work for couple of months. Stay strong, something will come up, it's important your wife is there for you! I've been in the same situation when I first applied for spouse visa and that rejection really hurt! I know exactly how you're feeling. Talk to a solicitor, see if you can complain or anything, look at your options. Just don't let emotions win over. Good luck and stay strong!

Don't give up. I'm sure there is a way to turn this around. What about long residency after your 3 years DLR?

I thought I should share my timelines with you.
Mine is a pretty straight forward case but I had submitted an outdated form by mistake. UKBA then asked me to submit the correct form (they said i just needed to send the form and that new documents were not required)

ILR posted : 22 Jan 2012
Fee deducted and Acknowledgement letter recieved: 24 Jan 2012
Letter recieved from UKBA saying I sent an outdated form and should submit the latest form: 25 Feb 2012
New application submitted: 28th Feb 2012

The dreadful wait finally came to an end on 01st May. Following are my details:

Application posted: 18-Nov-2011
Received at HO: 21-Nov-2011
Acknowledgement Letter: 22-Nov-2011

Sent Expedite letter by post in January to Croydon - No Reply
(I had included a self addressed Special Delivery Envelope with this letter which they have now used to send my passport back)

Sent Expedite letter by post in Feb to Liverpool - No reply
Wrote to MP who was kind enough to raise enquiry with UKBA on 2nd Mar
Sent email to SettlementOps last week - No response

Passport received on 01-May-2012
Stamp Date: 25-Apr-2012

Hi everyone,
I got a job offer and obviously don't have any way of proving that I can work because they have my passport and I only have a copy of my expired visa and the acknowledgement letter from the HO.
So, I've referred them to use the employer checking service as I was told when I rang them.
Has anyone used this service, do you what type of reply you get?
I'm supposed to start my new job on the 7th of June, subject to availability to work in the UK. I am being made redundant from my current job, so if they don't give them posistive answer I would have no income.

As long as you were not out of the country for more than 180 days, you will satisfy that criteria.

I been in same situation got job offer bt coz didn't hve any evidence to proof that I'm eligible to work in Uk. When thy offered me job I told them on phone that I don't hve passport only thng I hve is acknowledge letter frm home office . Thy said bring it on induction day. Which I did with my p45 . Thy said wen u get ur passport just bring it . N then thy put me training till finish the day . Went next day worked 12pm thn manger called me in her office n told me that letter is not enough to proof that I'm eligible to wrk here . Thy said thy need to see passport with valid visa. N suspend me . N said if I get my passport with in couple of days thy will see if thy still hve job .thy didn't even pay me hours which I worked there.;( I asked them will I pay for one n half day . She said he will find out for me thn he disappeared n never came bk ;(

Anyway not received my passport yet . Its more then 2 months now .I was wondering wat s employers checking service ? I hvent heard it before ?

I dont know what they actualy tell the employer .. i would think they say that they cant give any details but the rule is that you are allowed to work in the UK as long as your application is in process, if your accepted you can work indefinitly but if you are refused you will have to terminate your work right then.
you should make clear to you future employer that you are expecting a positive outcome and that your not worried that your passport will come soon enough (probably not long after your start date)

im in the same situation.. except i've not really told them about my visa situation as they have not asked... im really hoping ill get my passport back and if i dont ill have to do what your doing now .. if it comes to it i though that i could offer them to hold my pay until i do get my passport. that way they wont loose income on me if im refused. which is vey doubtfull.

all this is very stressfull... finding work is stressfull enough without having to do this .. please let me know what they say .. and if your offered the job :)

ps... maybe we could post as an employer, call the number and see what they say ??

Hi Ame, that is just awful, I would kill them if they did that to me.
May-Marie, fingers crossed that you get it in time.
The HR Department contacted me agian today saying that they have sent the form to HO and if I could please provide them with a copy of my NI number.
I wonder how long the HO office takes to give them an answer, I do not want to go to work the first day just to be sent back home.
The starter package said to bring proof on the first day of work, but I just want to avoid what they did to Ame. Meanwhile I will be going to other interviews to buy time...you never know.
