Re: COA not accepted for eligibility to work

Giffnock77 wrote:Thanks to inventors of this board. It has been extremely useful. I need direction or guidance with an issue I am having. My contract for work terminated in January of this year shortly before my EEA Family Permit expired. Shortly after that I immediately submitted my EEA 2 for my RC. Please see below. I received the COA within a reasonable time period and have been using this to apply for jobs. I successfully completed two interview process and got accepted for both positions but when I produced the COA for eligibility for employment in UK, I was advised by both prospective employers that they need my actual passport with the RC. This is frustrating given the fact my COA allows me to work. The good news is that one of the employer has confirmed job placement with the company once I can produce the RC. I have emailed the Home Office regarding this and query of my RC and was advised that they will forward my query to the appropriate team. This has been a week now and no response. If anyone has guidance or direction has to how to deal with this, please let me know. It's much inconvenience and it's difficult to proof to an employer your eligibility with just a piece of letter. I somehow wish the Home Office followed the same guidelines like the States offering an employment authorization card during the process - this would alleviate these situations. Thanks in advance for your guidance. :)

EEA2 mailed: 27/01/2012
Received by HO: 31/01/2012
COA Received: 17/02/2012
RC Received: ????
Can I make a suggestion? Start your own thread. Your point is far too important for it to languish in a timeline thread. Please do so an I would be glad to respond.

Hiya,

I am just wondering, my EU husband has not received his EEA1 certificate of application. But people seem to get theirs 2 months tops when the application is sent.

Or does it have to do with the fact that they need his document to process me eea2 application?

thanks

Feels screwed...

Post by shamababes » Sun May 06, 2012 4:25 pm

I feel so screwed by the UKBA.
On the EEA2 form it distinctly says "there is no legal requirement for direct family members of EEA nationals to apply to confirm their rights" (to paraphrase)
YET - whenever I am applying for a job the prospective employer is telling me that they are legally obligated to request documents proving my right to work here. None of them includes the EEA Family Permit! This means that the ONE thing the UKBA is telling us that we DO NOT need is the ONE they are telling employers that we DO need! Quite something eh?
Now I am a visa national who had been living in Ireland for almost 10 years married to an EEA national. Why are they not exercising commonsense with this matter?
In Ireland, the spouse of an EEA national needs only to go to an Immigration officer at a Garda station; bring relevant documents ie marriage cert (sorry unmarried partners); proof they are living in a sustainable relationship and a Stamp 4 is issued IMMEDIATELY.
Why cant every station here have an immigration officer - looking people in the eye and may even be better able to find the culprits waaaay more easily...smh

shamababes; apply for a residence card, you will receive a COA, which will show your entitlement to work.

Hi EuSmile...I have already done that. But my point is that since the residence card DOES NOT give family members of EEA national rights it CONFIRMS it, whats the big issue? If we can prove it to the employers on our own with the same documents we are going to be sending to the UKBA why cant that suffice till we get the residence card?
What is the purpose of a certificate of application taking a whole month to get to an applicant who does not need to apply for one in the first place?

It's not meant to take a month. It's meant to be issued immediately.

If you are affected and can't get a job, complain.

hello everyone, just a quick question

in order to work, do I need a COA/RC or not?
Im desperate to find a job and I was wondering, maybe I could ask for my passport to be returned and start looking for jobs with the marriage certificaten and passport. I havent received my COA yet, and when i emailed them had standard "progress reports are not given" reply.

The EEA Family Permit allows you to work and is listed as such. Point employers to page 35 in Comprehensive Guidance for Employers on Preventing Illegal Working.

FYI was on hold for 12 minutes before I got through, and they've raised the request based on compassionate grounds. FWIW you can also ring them on 0151 672 5626 rather than needing to call the 0845 number.

The systems must have gone down that is the only reason for this delay

it really kills me seeing people get their RC when they applied in APRIL!

Often when there is a big backlog cases will all get bundled together and dealt with in a certain way. When this happens, they'll often start focusing on newer applications and then go back and do the old ones.

Just to add, it's because of the stats. It's more beneficial dealing with the newer ones coming in as the old ones have already blown the stats for that time period away anyway.
