Regarding Tier 1 General Qualification - Urgent

Hi,

I have been rewarded my HSMP in May 2007 up to May 2009 and Tier 1 General in July 2009 to July 2012.

Now I am going for my Tier1 General extension in June 2012.

Am I eligible to claim points for my Bachelor's Degrees?

Senior Members please help.

An applicant can claim points according to the level of the qualification
he/she has. Please refer to Appendix A Table 2 and 3 and paragraphs 12-17 of the

Immigration Rules.

56. An applicant will be awarded no points
for a Bachelor’s degree if:

(a) his last grant of entry clearance was
as a Tier 1 (General) Migrant under the
rules in place between 31 March 2009
and 5 April 2010, or

(b) (i) he has had leave to remain as a
Tier 1 (General) Migrant under the rules
in place between 31 March 2009 and 5
April 2010, and
(ii) his previous entry clearance, leave
to enter or leave to remain before
that leave was not as a Highly Skilled
Migrant, as a Writer, Composer or Artist,
as a Self-employed Lawyer, or as a Tier
1 (General) Migrant.

The above will affect in your case. Means, you can claim points for Bachelors degree since your previous entry clearance or leave to remain was HSMP.

Just a thought, it seems like you are eligible for ILR. Why do you need another extension?

You can claim points for the qualification you used in you initial Tier 1 application. So if you claimed points for a bachelors then, you can do the same now. Looking at your dates, I'd say you may be eligible for ILR as well, unless there is something in your case which would result in you not meeting the residency requirements.

Thanks for your help longshift. I had a gape of around 9 months hence I am not eligible for ILR :( :?
