DEPENDANT ILR OR FLR???

Post by khubs » Tue May 08, 2012 8:15 pm

Hello everyone,

I really need advise on the following as I am very much confused.
All help will be appreciated.

I am due for ILR in Jan 2013 as I have been on hsmp+tier 1-g. Me and my husband got married in April 2011 but started to stay together since october 2011 as we were in two different jobs in different cities. He got tier 1 g dependant visa in June 2011. My question is when can he apply for ILR, Is it not the same time as me or would HE be eligible in APRIL 2012 as we would have been married for two years or would it be October 2012 as we would be staying together for two years?

HIS VISA EXPIRES ON 8/2/13

Pls. advise. as we are very confused.

THANKS A TON!!!!!!!

I think he may be eligible for ILR when you can show that you have lived together in the UK for at least two years. Note that time spent living together prior to marriage, in a relationship akin to marriage, may also count.

Thanks vinny for your reply.

I have all the documents from October 2011 of living together with my husband. Just 1 more question, as he is on Tier 1 dependent right now, when I apply for my ILR in Jan 2013, my husband obviously will apply for a FLR. So, can we combine our living together period between the 2 type of visas (Tier 1 dep and FLR) for eligibility for him to apply for ILR in October 2013?

I will really appreciate your reply on this as this will clear my mind up. Thanks a TON again.
