UK born Children eligibility without parents ILR

Post by muhami01 » Thu May 10, 2012 10:07 pm

Hi

My friend applied ILR application on SET 0 (Workpermit+HSMP+Tier 1) along with family.
He has got reply today after 7 months and was granted discretionary leave to remain for 3 years instead of ILR. He is quite unsure about this. The solicitor has advised him he need to remain in UK for another 6 years to be eligible for ILR again ( His stay will be 10 years in UK next year).
The only problem in his application once previously had invalid previously invalid application on his extension of HSMP visa ( he applied before his leave was due to expire however when leave expired he got his documents back due to invalid application (problem with photos) and was asked to re apply, though his was already expired and he was in this country without visa for 15 days..On submission of fresh application he got extension.
His 3 children born in UK can they be eligible for nationality ( 8 years old, 6 yrs and 4 yrs old) prior his ILR on any basis. Yet he is not sure on what basis he need to apply ILR again( 10 yr, 14 yrs residency or after completion of discretionary leave.

Yes, in two's years time (for 8 years old), if the UK-born child spends first ten years continuously in the UK.
