Urgent Query about Tier2 payscale. PLease help

Hi all

I am working as a programmer and my pay is 24300. My weekely hours is 35.
According to ukba programmer's salary should be 26000. But they calculate using 37.5 hours per week. On there guidance copy they have mentioned that -"Appropriate salary rates are based on a 37½ hour working week,
unless otherwise stated. Appropriate rates should be pro-rated for other working patterns, unless otherwise stated"
If my salary is calculated according to 37.5 hours my salary is more than 26000.

Can i apply with my current salary??

I think that may be applicable. However, I think if your contract letter categorically mentions 35 hours per week then that would be useful. Otherwise, I guess it only depends on the employers how many hours they want their staff to work on a full time role. Usually between 35-40hrs.

Also, it is worth writing a letter with this explanation I think.

Hi there,
Mine is a similar situation. I am thinking to apply for a Tier 2 visa as my employer is ready to sponsor me. The only problem I have got is I work 30 hours a week at £23500. But on a pro rata basis my salary becomes £29500 which is enough according to my SOC code. Can you please tell me if you got the visa or UKBA put an objection? Thanks.
