I know my husband overstayed for 1 year but that 320b rule shouldnt be a barrier for our visa. But i think his working illegally will get us refused under 320.11

thanks to the above people as you have pointed out nazia I too decided it was not in the best interests of the case my case will already been an extremely difficult one to pursue however having read many of the posts in this thread alot of the people on here have helped in preparation so I thank everyone in the thread who has provided valuable input and experiance in documents appealing and rejection reasons as it helps to build a solid case as possible even if it becomes time consuming!

if anyone can email me a template for a sponsor letter as I have no wages to show also due to difficulties i would appreciate it so hence my case difficulty!
You're welcome brother?

What do you mean by no wages?
Have you got a job? Are you earning?
Have you got any savings?
ok ill explain briefly due to illness and disability i cannot work, im fortunate to have understanding inlaws/relatives who have helped me over a long period of time and to state she is educated and could easily come to england on a student visa so there is nothing untoward i am on benefits but i have extensive history of illness and lack of employment she brought me stability and strength and i hope i can go in to employment in the future.

so you see i know im stuck!

(Short Story) - He was in the UK on student visa 2008 - 2010 when it expired and overstayed 1 year while continuing to work illegally. He was then arrested, detained for 2 months in detention centre and i paid for his flights and went back with him. We got married, i come back after 1 month and got job. Then we applied March. Waiting for result.

@ Y3NVY
Article 8 defines: Right to respect for private and family life. It is frequently used by the applicants in the appeal process; and to satisfy the Judge, they will give the visa by one way or the other but it takes time if you have any hindrances. Hope for the best and ask Allah (SWT) to make things easy for you.

One quick question.... I'm the applicant and I want to know that should I attach my educational certificates(or whatever you want to call them) with the application? I have done O and A level. Someone told me that if you attach them it causes unnecessary delays in your application. Is this true? I thought that it would be good to attach them as it would show them that I'm not completely uneducated.

Thanks in advance

I know its been hard for you. Family law is that you have every right to be with your child, and child with his father. Inshallah you will be fine that should be the first thing they look at. I don't think the judge can refuse your visa even if the eco do. Again I don't think they do unless there is something that is incorrect in the application just like mine.
U have been that patient just wait a little longer but yes you have very good grounds

I am now 8 months gone... im due next month. When he got caught I had just found out I was pregnant, But the officer looking into his case just said he has to go back with no right if appeal...

My Hubby filled out the application, He gave in the nikkah form but gave our wedding date as our ruksati in the uk.... so i got refused say stating that marriage was in the uk but a nikkah nama was submitted so this wasnt sufficent grounds for them....

They had no other restrictions. But he never worked here and was always supported by family and then me. He had handed his case in to sol 10 months prior.... but we didnt realise they had not handed the case in until the police pull him up. Then every thing was too late.....

You have a good case then if you pay for him that means he gone back willingly so they will close his old case and your will be a fresh claim

On the appeal letter they stated that if i send all the reqired documents then this matter maybe dealt without it going into appeal. My uncle told me this is the first appeal letter that he has seen where it say's that.

My rejections sound really simple but to be honest my hubby gave the wrong date and location.... so how can they say yes. They may have realised he just put in the incorrect date but what is written is all they have to go by so im not angry at them they are doing their job.....

Courts here are doing their job too its just a shame its a long process but at the end of the day I know I will win..I know allah wont let me down and i know that the longer he is away the more my hubby will appreciate me i hope.

I am going to My MP tmr... i have been doctors about stress so i wanna get him to help as it will get harder when the baby gets here. I also have a 12 year old from my first marriage. I dont wanna be in a position where i need to stay in hospital or something and i have no one to look after her that is Her step dad's job too. We are all family and they need to understand how important family is
