ILR - 30 days over for 180 days period

Hi,

I am completing my 5 years period on May 2012 but i have total breaking period days for more than 180 days (30 days more) and not more than 90 days in a single time. I would need a help to understand when will i be eligible to apply for ILR?

Plz help me.

how many business trips days and personal? if you can get a letter from employer confirming business trips then it should not be a big issue.

Extra 30 days absenses are personal ones..

Were you under permanent employment in the UK when you went outside the country? And were your absences paid annual leaves?

10 days in out of 30 days absenses are non paid personal holidays

I have the same problem with 45 days over the 180 days cap, all absences consistent with annual paid leave (but were not for business, rather for annual holiday and Christmas closures, but all paid leave and I am permanent in my post with the same employer throughout the 5-year period). none of the single absences exceeded 90 days.

Please advise on what I should do and whether I still qualify for ILR when I complete 5 years. or shall I rather extend into Tier 2 (genera) then apply when I have less than 180 days total absence.

Your advise is much appreciated.

Absence in line with your employment contract (i..e paid leave) and business trips are not counted towards the 180 day rule.

Dear members,

I have similar situation;

Total absences:241 days, All these days I was on paid leave.
There was a demise of family member & had fractured my leg in between( 26days & 47 days) for which I can produce the certificates.

So over all leaves me 168( 241-73) days absences......

Can still apply for ILR??

Please suggest me.
