UK entry within 90 days of entry clearance - ILR Eligibility

Post by tinku » Sun Jun 03, 2012 7:21 pm

Hi There,

Arrived in UK after 50 days of start of entry clearance visa. Am I eligible for ILR 28 days prior to the 5th anniversary of my Tier-1 visa ?

Can I go with PEO appointment or submit application by post.

Will appreciate your advice here.

Cheers,

Depends when your current leave expires. If your visa expires 5 years after the "valid from" date then yes. See (top of p4):

either, but the premium service is only for straightforward applications. The postal application may take considerable longer than the premium service.

Cheers,

Yes you can apply as long as you have entered the UK within 90 days of your initial EC grant.

So dont worry about another extension

EC Visa start - 31/07/2007 (2 years HSMP visa non JR)
UK Arrival - 05/09/2007
Tier 1 General till 31/07/2012 (3 years on Tier-1 )

Can I apply for ILR on or after 05/07/12 ?

Since your leave will expire before the 28 days window preceding the 5th anniversary of your entry, you may take advantage of the concession.
