Guardian article reveals that new rules under family immigration are to be implemented next week. My question is whether this applies to non-EU spouses of EU citizens or just non-EU spouses of British citizens?

These are changes to the National Immigration Rules; and therefore it does not affect people under the EEA Regulations in any way.

this is what puzzled me:

'Currently if you're British or >settled in the UK<' ...... taken from the JCWI article. does being an EU citizen and exercising treaty rights not count as >settled in the UK<?

Typical Guardian slant on things. You will notice how the paper gives only two examples using women with British sounding names. As any British resident knows, this is primarily aimed at arranged marriages of convenience from the Indian sub-continent and the regular fake marriages of convenience which have for years been used to circumvent immigration laws.

There was at one time a regulation called the 'Primary Purpose Rule' aimed at such issues but this was abandoned by the Labour Government in about 1997.

But as has been pointed out, it does not (can not) apply to applicants under EU laws.
