When can I apply for ILR??

When can I apply for ILR??

Hello Guys,

I Just want to ask one questions, If someone can answer this that will be really great?

I entered in UK on Tier 1 General in Oct 2009. I got married with British national in April 2010. I didn't change my Tier 1 General Visa Until Feb 2012. Finally I have changed my Tier 1 general Visa to 2 Year Spouse Visa in March 2012.

My Question is when I am eligible to apply for ILR??

Under current rules, March 2014.

That's mean when I was on Tier 1 General that doesn't count towards ILR even I was married to British National from April 2010??? So you have to be with your British spouse for two years on Spouse Visa to apply for ILR???

Yes that's right. It can't be included in the residence period that leads to ILR in the category of leave you have now. You should have considered switching in 2010 as soon as you married.

your question has already been answered. It was your choice to wait for two years to switch.

So it was a great mistake that I did'nt Change my Visa status when I got married 2 years before. If I would have changed my visa status when I got married I would have been eligible to apply for ILR now?


After getting ILR in 2014, do I have to wait for another year to apply for BC or I can apply right after getting ILR in March 2014???

Standard requirements or is there any specific requirements for Spouse Visa??? Can you explain please ?
