Tier 2 ICT Long Term Staff

Hello,

I am currently in the UK on Tier 2 ICT Long term staff visa. My Visa expires on Dec 2012. I got my Visa during June 2011.

Could you please help me confirm if my understandings are correct.
1) Since I got my visa after 6 April 2011 I can no longer switch to Tier 2 General even if I find a sponsor.
2) If I find a sponsor/CoS and return to India and can I apply for Tier 2 General from India (or will I not be able to do that since I would have to complete the mandatory 12 months cooling period)

Due to some personal responsibilities I need to stay in the UK, so if the above 2 options dont work, can I try to switch to Tier 4 Student visa (Keeping my dependant along with me in UK. I am aware I will need to spend some money and study a course). Please advice. Thanks..

1. correct, you cannot switch.
2. the cooling-off period applies, see Immigration Rules, 245HB(g)
