Tier 1 General Extension - Some Questions-- Please Clarify

Hello Guys,

Hope all of you are ok.

It's that time of the year where I would start planning for my next extension. I am currently on Tier 1 Gneral Visa approved on 31st Jan, 2011 and I applied in December 2010 from Outside UK. My current leave expires on 31st of Jan, 2012. I have got couple of dependents who joined me about two months ago and would be applying for their extension along as well.

Now, first thing first, since my leave was approved after new set of rules came in July, 2010 and I got initial leave to remain in UK for about two years so does that mean I will get three years this time around? Please clarify.

As I understand from the Guideline that I would need 80 points because my initial application was after April, 2010. Is that correct??

1. I am under 30 so I would get 20 points. right? I am really confused about this.. Do they calculate points for your age every time you apply for extension?

2. I will get 30 points for a UK Bachelors degree. Do I still need to send the documentary evidence considering that my last application was approved on the basis of same degree???

3. My earnings are in the bracket of £40,000 - 49,999 so that would award me another 25 points?? I will send 12 wage slips and 12 months bank statements to show salary credits. Would that be OK??

4. The biggest confusion I have got is with regards to UK experience. Am I right that I will get 5 points because £25,000 of my earnings were actually earned in uk since my initail application was approved after April, 2010?

so, Age(20) + Qualification (30) + Earnings (25) + UK Exp (5) = 80

Please let me know if above total is correct or am I missing something??

5. Also, my initial application was approved on UK Bachelor degree so I don't need to send evidence for English Language. correct??

6. Now the maintenace. Since the new rules came into force, I understand that maintenace funds has been increased for Tier 1 Migrant to £900 and for every dependent to £1800 if they are in the UK for less than 12 months. Since, I have been in UK for more than 12 months now so my maintenace will remain £900. The mainteance funds that I need to show for the period of 3 months will amount to £900+£1800+1800 = £4500. Is that correct??

Sorry for the long post but I will appreciate if someone would take pain to clear my doubts.

Thanks Sushdmehta as always. Does that mean that I will get the same points as I got on the previous occasion for my degree as well??

You would get the same points for your age as that of of your intial application.
It would be the same for qualification as well i.e 30 points for UK Bachelor degree. You can tick the box on application form that reads 'Evidence previously provided with the applicant’s initial Tier 1 (General) application'

Thanks Silent Warrior! What about the UK experience. If my initial application was applied after 04th of April 2010 and I have earned £25,000 in UK out of my total salary then that would grant me five points??

Your UK experience points are based on the salary earned in 12 months claim period (from within the last 15 months). If you earn more than 16K you can claim UK experience points.

If you received 2 years already then they would now grant you a 3 years leave inorder to have a total of 5 years (2Initial + 3 Extension) of leave to remain to apply for ILR

If you initial leave was 2 yrs ... you should get 3 yr extension.

Its not £1800 for each dependant. its £600 for each along with £900 for primary application if applied after 14th June 2012 otherwise £900 + £533

Tapas, my dependants have been in UK for less than 12 months. As per UKBA website, I need to show £1800 per dependant + £900 for myself.

Myself + 2 X Dep = £900 + 2 X £1800 = £4500

I think this is the amount I need to maintain for three months before my application. Please let me know if this is correct

ah!!! that was bit tricky. I was thinking other way around. Can I ask you couple of more things if you don't mind...

1. Since my initial leave was granted after April/July 2010 so I would secure 25 points for earnings in the bracket of £40,000 - £49,999. Is that correct?

2. I changed my address recently and think one of my bank statements has been lost in the post. Do you think it would be ok if I submit one or two out of 12 months statements as duplicate...

As per the Table 3 yes you will get 25 points for earnings between £40,000- £49,999.99
For the bank statements, yes you may submit duplicates, but make sure your duplicates have to meet the following (check point 164 of the guidance notes)
The personal bank or building society statements should clearly show:
• the applicant’s name;
• the account number;
• the date of the statement;
• the financial institution’s name and logo;
