Kiwi lad married to an Irish lass

so my timeline is

EEA 2 Applied for 12 Feb 2012
Received by HO 13 Feb 2012
COA received 16 Mar 2012 (dated 9 Mar 2012) with full right to work
Requested Spouses Passport Back 22 May 2012
Received Spouses Passport 29 May 2012
No RC as yet after months

but I requested my passport back as I need to travel, and the home office promptly responded saying they had sent my COA and my Spouses passport to me already, as they were confused as to what I wanted, so i called them to explain.

Upon calling them I was told that if I left the country with my passport that I would have to apply for a family permit from NZ before returning to the UK even though I have a COA stating right to work in the UK.

They did say my application would continue, but that I would not be allowed re-entry without a family permit (even though technically by EU law you don't even need an RC to enter when you are married and travelling with your spouse).

Anyone here travelled with the passport and coa with no family permit???

I sent in a letter quoting my reference number aswell as a special delivery envelope last week saying it was urgent. Within 5 working days I have received my RC back. So if it really is urgent, I suggest you send one in. Good luck

The advice given regarding the Family Permit is wrong. A Kiwi passport would get you on a plane. A CoA would get you pass the border.

Would a COA be good enough to get you through the border? has anyone done this???

I just called and got the default answer that I should call next week.

Then I asked " are you saying I should call next week" and the lady said that "im not advising you to call next week, Id advise you to wait, it might be resolved by then"

So ill nag them endlessly by Wednesday. I really dont see them giving it to me by then but stranger things have happend

I asked my EU partner's passport back on 30 May and nothing received yet. The contempt of this particular HO department is beyond anyone's imagination. We have been waiting for nearly 6 months by next week and I have little or no hope that further nagging is going to make any difference. They clearly couldn't care less.

I've just called them and I was told my no decision has been made on my application!!

Can you believe that. I told them I have no confidence in my application being processed before the deadline and I was just told to call back the day after the 21st because they received the application on the 20th

I thought it was from the day you send the application not the day after they received it?

this is so frustrating!!

hi guys i send them email and reply like this
Thank you for your email to the UK Border Agency, Liverpool European Passport Returns. This in- box is specifically for requesting the return of passports or identity documentation submitted with applications made under the European Economic Area Regulations of 2006.

If you have made an application for a Residence Card or Registration Certificate under the European Regulations, please provide your name, passport/identity card number and if applicable postage reference number.

Your request will then be directed to the relevant team for resolution.

We will endeavour to return your documentation as soon as is possible, usually within five working days, from when the passport has been received onto the relevant team and processed into this department. However there may be exceptional cases where it takes longer. So we strongly advise that you do not book any travel arrangements until your application has been fully considered.

Please be advised that your application will not be expedited alongside the request to return a passport. If your passport is not with UK Border Agency at the time of decision then you may need to make a new application should you require the transfer of your Residence Card into your passport.

We will not reply directly to your email, if your query relates to anything other than a request to return your documentation, further information upon our services can be found at: http://www.ukba.homeoffice.gov.uk.
EEA2 send 20th January 2012
