FLR (M) for my wife- PLEASE HELP!

FLR (M) for my wife- PLEASE HELP!

The UKBA document request states the following:

1. 2 recent passport photographs and your passport
2. evidence of your age and your partner's age
3. your marriage or civil partnership certificate
4. evidence that you were both free to marry or enter your civil partnership, if either of you was previously married or in a civil partnership
5. evidence that you have met
6. evidence of your English language ability
7. evidence that you can can maintain yourselves and any dependants adequately without needing public funds
8. evidence of your accomodation

I will be applying for an ILR this year in Sept 2012. The reason WHY I cannot apply for my wife's ILR (SET M) is because we are newly wed (Feb 2012). Hence, I will have to apply for FLR M instead for my wife.

My wife is currently in the UK on a Tier 1 General Dependant VISA. All these documents like evidence of our marriage, evidence we met, availability of funds etc etc were already provided to UKBA during the time when she applied for her entry clearance from India. Do I need to provide for these documents again?

You'll need to provide all the documentary evidences required for FLR(M) application.
Reading the opening post of this topic should give you an idea about the documentary evidences needed.

Hi,

I posted this some time ago but did not get any response. I will be applying for SET (O) in Aug-Sept 2012. For my wife I will be applying for FLR (M). Is there any funding requirement for FLR (M)?

Many thanks Sushdmehta. I had a look under Appendix E but that did not say any AMOUNT which I require to show. It says that if someone got entry clearance before 9 july 2012 then old rules for maintenance funds will be required to be shown. How much is it for old rules? When I applied for my wife's tier 1 general dependent visa it was £533 for 90 days for someone who has been a resident in the UK for >12 months.

Hi,

Thanks for the info.

My wife is currently holding a Tier 1 General Migrant dependent visa. Later on when I get my ILR she will be on a FLR (M) visa.

Can someone please provide me with a link to the UKBA website which shows that she is ALLOWED to take up FULL TIME employment with a UK employer under Tier 1 General Migrant dependent and FLR (M)?

PBS dependant - 319D(b).
FLR(M) leave (as spouse) - No restriction, hence nothing documented, and no link to provide.

Hi,

Many thanks. I saw that guideline but it specifically does not say that their is full working right in the UK.

My wife got a job but the employer wants something in written to prove that she has FULL working right in the UK. Can you please help?

No one can.
Immigration rules and associated policy guidances document the "requirements" and "restrictions" (if any) ..... not non-requirements or imaginary restriction(s).

Ask the employer to call up UKBA and enquire about the "right to work" for a PBS dependant and a spouse of a settled person or British citizen. That is the only way they can find out what they are looking for.
