Switching Tier1 General to Tier1 General Dependent

Hello,

Please advise as I am currently on Tier 1 General and decided to switching to Tier 1 General dependent category.
My query is whether I can apply from inside the country or I need to go back to my home country to apply for the visa?

Background information-
I live in UK since 2007.
Got my Tier 1 inside the UK in 2010.
My Husband is having Tier 1 General since 2008.

There is a difference between you having a valid leave to remain on Tier 1 General, and you switching to a dependent route of a Tier 1.
From the information provided by you, it seems that you are currently on a Tier 1 General Visa.
Whereas the rule says
You can apply for permission to stay here as the dependant of a migrant under Tier 1 (General), without having to leave the United Kingdom and apply for a visa if:
your last visa to enter the United Kingdom or permission to stay here was as the partner or child of a person who has valid permission to enter or stay here as a migrant under Tier 1 (General), or who is at the same time being granted permission to enter or stay here as a migrant under Tier 1 (General)

So, as you were not on a partner or dependent visa of the Tier 1 General migrant before, you would need to leave UK and apply for Entry Clearance

Work > Tier 1 (General) > Dependant Partner

MY visa is going in finish on 27th August and I am going to apply for visa on 25th June. I hope i can apply in advance.

Second I need total 1600 maintenance funds for 90 days (1 dependent + 1 Main applicants). My daughter is already dependent on my husband visa so we have not added her maintenance funds.

"This page explains the requirements for maintenance (funds) that you must meet if want to apply for permission to enter or remain in the UK as the dependant of a migrant under Tier 1 (General) of the points-based system.

To qualify for a visa or permission to stay as a dependant of a Tier 1 (General) applicant or migrant, you must show that you have enough personal funds to support yourself for the entire period of your stay.

Your evidence must show personal cash funds which are held in savings or current accounts. Other accounts such as shares, bonds, overdrafts, credit cards, and pension funds are not accepted as evidence."

Do dependent have to show his/her own personal funds as mentioned above or it can be only in the main applicant bank account??

I was asking you to read a topic in the forum (the title and link of which I had provided) but you thought I was asking you read the UKBA policy guidance for dependants.

I have read all the links. To be honest more I read, more i get worry.

Dependent can show his/her own personal funds OR it can be the main applicant's bank account, either would work. So should work for you if husband's(main appilcant) account has sufficient funds for the 90 days period. There is some confusion on how much maintenance is required though. Clause 47 of the dependant policy guidance states

47. If a family member applies separately from the Tier 1 Migrant, there must still be enough funds
to support each member of the family. Therefore in the example above, if the family has a third
child, the main applicant has been in the United Kingdom for two years and the family applies
for leave to remain for the third child separately, they must provide evidence that they have an
additional £600 in available funds.

My interpretation of this is that if there are 2 dependants and main applicant is in UK for more than 12 months, the maintenance fund required is £900 + £600 + £600 = £ £2100

Whereas others believe it is just £600 if only one dependant is applying irrespective of the number of dependants in the family staying in UK along with the main applicant.

Your interpretation is wrong. In any situation where the PBS migrant (main applicant) is not applying at the same time, there is no requirement for the main applicant to show maintenance for him/herself.

Applying separately is a mere technicality. It seems logical that one would need sufficient funds to sustain a family as a whole in the UK, irrespective of when the individual members apply.
