Tier-1 extension but initially under HSMP

I have got HSMP approval letter in Sep 2006, got HSMP visa in 2007 but I was outside UK for more than 6 months so I am not eligible for ILR and I need to go for extension now. I am not getting any points for my bachelor degree in points based calculator as I have got my first Tier-1 in May, 2009 when there was no points awarded for Bachelor degree. When I tried to call UKBA they said I need to enter my first Tier-1 application date in points based calculator but not my 1st application date for entry clearance. I feel this is not fair but I dont know what to do. They have suggested me to switch to another catogery like Tier-2 if I am not getting enough points. Any help?

Then you are not subject to PBS rules and policies.

Apply for extension using FLR Tier 1 (HSMP) form. Read the associated guidance first.
