I applied through my solicitor last year in October 2011 and by mid October he told me he sent the application. I asked him for updates in December, nothing. Then in February, he called me saying he received the COA. When it arrived, I saw ''application received 24th of January'' and the letter was dated 24th of February, with rights to work.
I don't know whether it is because I overstayed and the HO had my passport for a while before I applied.
I requested my partners passport last thursday and recieved them today. Im hesitating whether I should email them or not but dont know what to ask!

This is what I don't understand. We have sent them 1 letter, 1 fax and 2 emails. No reply whatsoever. Not even an acknowledgement saying they have received it.

How can home office just ignore people?

I dont think that it is because of overstay. It look to me that your application wasn't sent on time .As HO received in January and they are accountable to give you answer once your application would be 6 months old in their possession. I am sure you will receive before or just after 24 July. Yes things are very unfair sometimes. But we can pray and hope for best. Good luck

I just got off the phone again with them and I was told there is absolutely nothing I can do except email the complaints department which I just did

As it stands no decision has been made on my application and the lady said she cannot confirm that a decision will be made by the deadline so ill just have to keep on calling like crazy on the 20th

I have to relax tomorrow but its just so hard with my flight coming up

samelamin, don't worry about catching your flight. If you miss it, you will successfully claim compensation from the UKBA! they will not have any excuse for not processing it within six months of application.

There is a statutory obligation to process within 6 months (17(3) Immigration (EEA) Regulations 2006). The UKBA will have breached this obligation. As a result, you suffered a financial loss (you will list all losses flight costs etc) and you are entitled to claim all that in a court of law. Obviously, do write to them NOW on NWCSU@homeoffice.gsi.gov.uk and explain the situation. Subject: URGENT, possible LEGAL ACTION.

Do NOT wait until wednesday with the email! also, I do have a feeling it should be fine. You just need to keep complaining!!!!

I wrote the email quoting that

"“Chapter 5: Residence Card applications
5.1.8 Six-month rule

Community law requires us to decide applications for a Residence Card within 6 months from the date of receipt of the application. Every effort should be made to do so, particularly where an applicant draws our attention to an alleged breach of this requirement. Failure to comply with this requirement could leave the Home Office open to a claim for damages.“"

But ill send the same email with the subject you mentioned

Thats probably why they never replied, i send it to that email and the complaints email which is NWCSU@homeoffice.gsi.gov.uk

Honestly I dont think i can do anything other than wait for deadline day :(
I have waited for almost 6 months whats another 2 days right

Logically it makes sense but the fact that I might miss my flight is making me panic

Hey guys, I just called the HO, they told me my application was indeed sent in October but was sent back. (something my solicitor didnt inform me) and was sent again in January. Lady on the phone couldnt tell me why, she guessed it must have been due to some insufficient documents provided.
She couldnt give me any updates and told me I gotta wait till the 24th of July!
Meanwhile, gotta light up a candle and pray!

I did call them today as they advised me last friday, spoke with a lady and all what she said is no decision yet and continue to wait.

i told her 6month finished and she said send a complain letter by post.

will have to call again tomorrow,

god willing,

sorry about the caps but theres nothing to stop them doing this to me even if I threaten legal action for missing my flights

I was really hoping you would get good news Danz im sorry, is your case complicated?

I realy think requesting our passports made things complicated. Did they tell you why its taking so long to decide? did you ask for them to email the case worker

it makes u feel really helpless when they say all u can do is wait and post a letter to complain, what good will that do

I just called them and I can confirm that after the 6 months are over, the call centre does NOTHING but check progress. Meaning that the case worker could easily keep your documents and the call centre will say a decision has yet to be made

guys find the fax now on this forumnand send a compliant,it goes straight to the caseworker, so one of them canpick it up and check your case....my 6 months will b up on 6th of juuly, however i called thurday was told case dealt with but not decided yet, dont know wht dat means, just wanna chill till end of the months and i will call, email and fax them,,,all d best guys

No it is straight forward application, even i did not request my wife passport they send it on their own. I did not call them or email them till last friday. they have my passport i didnt requested.

i asked her if is assigned to case worker: she replied only: " is being dealt with but no decision is been made yet, please be patient and continue to wait"

so i complained about 6 months and i did ask for the case worker name or email and she said cant release such infomation by phone and if i want i can write a complain and she gave me the address and department.

hope will hear good news shortly, best of luck for all.

WHICH ADRESS did she give you and have you written it, i think the best thing to do,is complain to the northwest,, fax them a letter, letting them know about the6 months rule.......

the thing is they won't be able to tell you why it'd taking so long, only if it has been decided or not which is just useless if the deadline is over. ESP to me as I don't understand why its taking so long or why they don't want people to know


I'll send them a FAX bit what is the correct number as there are loads of numbers and complaints emails? also how can you be sure a FAX to the complaints department goes to the case worker? has there been evidence of this?

there are loads of emails and I've sent my email to every single one threatining legal action but I haven't even received an acknowledgment which might be because nh deadline isn't up. I'll be doing the same come Wednesday but they seem to think only sending an actual letter will do.


I don't understand how a complaint will cause the case worker to take action as there is no past proof of this

and ccd my partner and SOLVIT. I also wrote to my local MPs explaining the situation and informing them that by law the home office are required to make a decision by 6 months. and attached my flight tickets and hotel bookings stressing that i need it resolved by next Wednesday


I dont know what else to do, im planning to fax them tomorrow as I dont feel a letter will do anything seeing as i sent two letters already one of which had a next day delivery envelope

any ideas what else I can do guys?

Our MP ( the mayor of southwark ) has replied saying she is sorry to hear about our situation and has sent another email to another MP in the hopes that we get our application resolved
